A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM AUTHORIZING THE
CITY Fu%NAGER TO BIND THE CITY FOR
THE ACQUISITION OF EQUIPMENT,
MATERIALS, LABOR AND SERVICES IN
THE EVENT OF EMERGENCY SITUATIONS
CONCERNING THE CITY'S UTILITY
SYSTEMS AND RESCINDING PRIOR
RESOLUTIONS NOS. 84R-7 AND 86R-190
WHEREAS, the City of Anaheim (City) provides
electric, water and other services (Services) to persons and
property located both within and beyond the boundaries of the
City; and
WHEREAS, from time to time the City's Public
Utilities Department (Utilities) requires the services of
independent contractors (Contractors) to assist Utilities in
natural or manmade emergency situations when Utilities has an
insufficient number of personnel and/or insufficient materials
and/or equipment to expeditiously restore service to normal
operating conditions or to maintain service during such
emergencies; and
WHEREAS, the City desires to expedite securing
services of contractors having sufficient personnel and/or
materials and/or equipment to assist Utilities during such
emergencies; and
WHEREAS, pursuant to City Charter Section 518, the
City Council may authorize the City Manager to bind the City for
the acquisition of equipment, materials, supplies, labor services
and other items included within the budget approved by the City
Council.
NOW, THEREFORE, BE IT RESOLVED, by the City
Council of Anaheim that the City Manager is authorized during the
existence of an emergency declared by the Public Utilities
General Manager or his designee to negotiate on behalf of the
City and bind the City for the acquisition of equipment,
materials, supplies, labor, services, and/or other items needed
in emergency circumstances subject to the following conditions:
(1) that there are sufficient funds in the
current Budget to compensate Contractors for
services performed; and
(2) an emergency, in the opinion of the Public
Utilities General Manager or his designee,
exists to such an extent that Utilities does
not have sufficient personnel and/or
materials and/or equipment to restore and/or
maintain service during such emergency; and
(3) the term of any such Agreement signed by the
City Manager shall expire at midnight on the
day of the day of the first regular meeting
of the Anaheim City Council after the Public
Utilities General Manager or his designee
requests a Contractor to undertake work,
unless the Anaheim City Council at that
meeting authorizes the Contractor to continue
work.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City
Council of Anaheim that Resolution No. 84R-7, approved and
adopted on January 10, 1984, and Resolution No. 86R-190, approved
and adopted on April 1, 1986, be, and the same are hereby,
rescinded and of no further force and effect.
THE FOREGOING RESOLUTION is approved and adopted
by the City Council of the City of Anaheim this 6th day of
June , 1995.
