A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING A PORTION OF OLD LA PALMA
AVENUE LOCATED GENERALLY WEST OF WEIR CANYON
ROAD AND NORTH OF LA PALMA AVENUE (00-12A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and,
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by
law; and,
WHEREAS, on the 24TM day of October, 2000, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that
portion of Old La Palma Avenue, particularly described as
follows:
See Exhibit A attached hereto,
provided, however, that this action shall serve only to terminate
the rights of the public to use said street, highway, or public
service easement and shall not be construed to convey or
relinquish any property interest of the City of Anaheim in and to
said street, highway or public service easement.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of the
County of Orange.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange upon the occurrence of the following:
1. The Director of Public Works shall certify, in
writing, to the receipt of the payment of $65,500.00
pursuant to a contract entered into between the City
and a private party pertaining to the area being
vacated by this resolution.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 24~h day of October,
2000.
