An Ordinance Providing for the Disposi-
tion of Garbage in the City of Anaheim
And Providing a Penalty for all Vio-
lations Thereof,
The Board of Trustees of the City of
Anaheim do ordain as follows -
SECTION For the of tt.is
Ordinance, the word "garba a"7 de-
fined to be all animal and vegetable ref-
use from kitchens anu all household
waste that shall have been prepared for
or intended to be usea for rood for
human consumption, or shall have re -
suited from the preparation of food for
human consumption.
SECTION 2. It shall be unlawful for
any person, firm, or corporation, either
as owner, agent, employee, or otherwise,
to remove or convey, or to cause or per-
mit to be removed or conveyed, any gar-
bage upon, along, or across any puolic
street, alley, highway or other public
place in the City of Anahe_m, watnout
first applying for and receiving a permit
therefor, in writing, from the Board of
'rrastees of the City of Anaheim, in the
manner hereinafter prescribed, provided,
however, that the provisions of crus sec-
tion shall not apply to any person, firm
or corporation with whom the City of
Anaheim nas entered lnco or may here-
after enter into a coni act for the con -
lection, removal anu disposal of garbage,
or to any agent or employee of such Per-
son, firm or eorporanori, whale acting
in the performance of such contract, and
while the same shall remain m furl force
and effect.
SECTION 3. Any person, firm or cor-
poration aesiring to obtain a permit to
remove or convey any gafoage upon or
along any public street, alley, highway,
or other public place within the city of
Anaheim, shall sign and file an appuca-
tion therefor in writing, with the board
of 'Trustees of such city, winch appi.ca-
tion snarl set forth the name an. au-
uress of the applicant, the location by
street anu number, or other tlUftie_ent
uesignatnon of the place from which it is
proposed to remove such garbage, the
place to which the same is to be removeu,
and the average number of gallons or gar-
bage per weex to be so conveyed. Such
appncant shall agree in such application
to confoinn in an respects to, and obey
all ordinances of the City of Anaheim
now in force, or that may hereafter be
adopted relative to the collection, re-
moval, or disposal of garbage, and shall

not dispose of, nor cause, nor peimrt to
be disposed of, any of such garbage
within the city limits of the City of Ana-
heim, and will not sell or aeliver, or
cause or permit to be sold or delivered,
any garbage to any person, firm or cor-
poration that disposes of or will dis-
pose of the same within the corporate
limits of said city, anu any such permit
may be revoked and annulled at any time
by tine Board of Trustees of said city.
SECTION 4. No permit shall be giant -
ea to any person, firm or corporation to
remove garbage from more than one
house or place of business, and no permit
granted pursuant to the Provisions of
this Ordinance shall be assigned or trans-
ferred without the consent of the Board
of Trustees of the City of Anaheim, en-
tered upon the minutes of said Board,
and no permit shall be issued for a per-
iod of longer than three years.
SECTION 5. In the event that any
person, firm or corporation, holding a
permit to remove or convey garbage up-
on or along any public street, alley,
highway or public place in the City of
Anaheim, shall violate,, or shall cause or
Permit to be violat,A any conditions of
such permit or any provisions of this
Ordinance, or of any ordinance to be
hereafter enacted, relating to or regulat-
ing the collection, removal or disposal of
garbage, or shall remove or convey, or
shall cause or permit to be removed or
conveyed such garbage in an unlawful,
improper or unsanitary manner, it shall
be the duty of the Board of Trustees of
the City of Anaheim, in addition to the
other penalties provided by tnis Ordi-
nance, to revoke such permit issued to
such person, firm or corporation. If the
Permit issued to any person, firm or
corporation pursuant to the provisions
of this Ordinance to remove or convey-
garbage, shall be revoked, no permit
shall thereafter be granted to such per-
son, firm or corporation to remove or
convey garbage.
SECTION 6. It shall be unlawful for
any person, firm or corporation to re-
move or convey or to cause or permit to
be removed or conveyed, any garbage up-
on or along any public street, alley,
highway, or other public place in the
City of Anaheim, except in water -tight
vessels, receptacles, tanks or wagon -
boxes constructed of steel, galvanized
iron, or other metallic substances and
mounted on wheels. Every such ves-
sel, receptacle, tank or wagon -box, while
the same contains garbage, shall be se-
curely and tightly covered and closed in
such a manner as to prevent the con-
tents thereof or any odor from escap-
ing therefrom. Every such vessel, re-
ceptacle, tank or wogon-bax shall be
thoroughly cleansed daily, and disinfected
at least once during each week. Every
vessels, tanks or receptacles for hold-
ing garbage. Every- such vessel, tank
or i eceptacle shall Toe constructed of
metal and shall be water tight and
shall be so constructed as to con-
tain not less than three nor more than
sixteen gallons, and shall be provided
with handles on the outside thereof, and
with a tight fitting metal cover. Such
corer shall not be removed therefrom
except when necessary to place therein
or to remove garbage therefrom, or when
the same is being cleansed. Every such
vessel, tank or receptacle shall be kept or
placed in the following manner:
Where there is an alley in the rear of
the premises of the person using such
vessel, tank or other receptacle, the same
shall be placed on the premises within
tile feet of the property- line of said alley;
When there is no alley in the rear of
such premises, and there is an al.ey or
street along the side thereof, each ves-
sel, tank, or receptacle shall be placed
on the premises at a point in the rear
of said lot or premises and adjacent to
said alley or street e_tending along the
side thereof;
Where there is neither alley nor side
entrance, each such vessel, tank or re-
ceptacie shall be placed in the rear of
such premises, at such place and in such
nr,.nnetas to be accessible to any per-
son licensed to collect garbage as here_n
provided, or to any person with whom
the City of Anaheim may have entered
into it contract for the disposal and dis-
position of garbage. After any such ves-
sel, tank or recptacle shall have been
empt_eo by the garbage collector, whether
he be a person licensed to collect gar-
bage as herein provided, or a person
with whom the City of or
may
have entered into a contract for tine col-
lection of garbage, the same shall be re-
turned by him without delay to the
Place where same was found.
SECTION 9.. It shall be unlawful.
for any person, except the person
holding such permit for the collec-
tion or garbage, or a person with whom
the City of Anaheim has entered into
a contract for the collection, removal and
t_isposai of garbage, to Interfere in any
manner with any vessel, tank, or recep-
tacie or the contents thereof, or to re-
mote any such vessel, tank or receptacle
from the location where the same was
Placed by the owner thereof or to re-
move the contents of any such vessel,
tank or receptacle. It shall be unlawfil
for any person to place, or cause or per-
m_t to be placed in any sach vessel, tank,
or receptacle, any substance other than
garbage.
tiEC'i'fON 10. It shall be unlawful for
any person, firm or corporation to de-
posit or to cause or permit to be depos-
ited, any garbage upon or in any por-
ton of any street or alley or other pub-
lic place or upon any Premises in the
said City of Anaheim.
SECTION 11. Any person, firm or cor-
porationviolating any of the provis-
ions of this Ordinance shall be deemed
guilty of a misdemeanor, and upon con-
viaYon thereof, shall be punished by a
fine not exceeding One Hundred Df)]-lars, or by imprisonment in the City Jail
or said city- for a period not exceeding
fifty days, or by both such fine and im-
omnent.
SECTION 12 All ordinances and parts
ofordinances in conflict with the pro-
visions of this ordinance are hereby re-
pealed.
SECTION 13. The City Clerk of the
City of Anaheim shall certify to the pas-
sage of this Ordinance ani cause the
same to be published once in the "Ana-
heim Gazette, a weekly newspaper of
general circulation, printed published and
circulated in the said city.
SECTION 14 That for tine reason that
this Ordinance is passed for the immed-
iate Preservation of the publichealth,
the same shall take effect and be 4Pull
force from and after the date of its pub-
lication as provided in Section 13 of this
Ordinance.
That the facts constituting the urgen-
cy of this Ordinance are as follows: That
there exists no effective ordinance in
the City of Anaheim, providing for the
Proper disposal of garbage in said city,
and there does not now exist any person,
firm or corporation licensed or author-
ized by said City to collect and dispose
of garbage within said City and that the
absence of such effective ordinance and
proper facilities for removal and dis-
posal of garbage constitutes a menace
to the public health of said city.

be the duty of the Board of Trustees of
the City of Anaheim, in addition to the
other penalties provided by this Ordi-
nance, to revoke such permit issued to
such person, firm or corporation. If the
permit issued to any person, firm or
corporation pursuant to the provisions
of this Ordinance to remove or convey
garbage, shall be revoked, no permit
shall thereafter be granted to such per-
son, firm or corporation to remove or
convey garbage.
SECTION 6. It shall be unlawful for

any person, firm, or corporation hold-
ing a permit issued by the Board of
Trustees of the City of Anaheim, pur-
suant to the provisions of this Ordinance
to fail, refuse or neglect to remove all
garbage from the place in the applica-
tion designated for such permit, at least
once in every eighty hours.
SECTION 8. It shall be the duty of
each owner or manager of any boarding
house, restaurant, hotel, or eating house,
and of every person occupying a dwelling
within the City of Anaheim, to provide
or cause to be provided, and at all times
to keep or cause to be kept, portable

SECTION 11. Any person, firm or cor-
poration violating any of the provis-
ions of this Ordinance shall be deemed

The Board of Trustees of the City of Anaheim do ordain as
follows;
SECTION 1.
For the purposes of this Ordinance, the weed "gar -
bagel' is defined to be all animal and vegetable refuse from kit-
chens and all household waste that shall have been prepared for
or intended to be used for food for human consumption, or shall
have resulted from the preparation of food for haman consumption.
SECTION 2.
It shall be 'unlawful for any person, firm, or cor-
poration, either as owner, agent, employee, or otherwise, to re-

applying for and receiving a permit therefor, in writing, from

enter into a contract for the collection, removal and disposal
of garbage, or to any agent or employee of such person, firm or

SECTION 3.
Any person, TI-rm or corporation desiripp, to obtain
a permit to remove or convey any g-ti.rbage upon or alone, any public

Anaheim, shall sign and file an application therefor in writing,
with the Board of Trustees of such city, which application shall
set forth the name and address of the applicant, the location by
street and number, or other sufficient designation of the place
from which it is proposed to remove such garbage, the place to
which the same is to be removed, and the average number of gallons
of garbage per week to be so conveyed. Such applicant shall agree
in such application to conform in all respects to, and obey all or-
dinances of the City of Anaheim now in force, or that may hereafter
be adopted relative to the collection, lx rem val, or disposao ger—

bage, and shall further agree that such 0(p 1-e�s shall not dis-
pose of, nor cause, nor permit to be disposed of, any of such gar-
bage within the city limits of the City of Anaheim, and will not
sell or deliver, or cause br 'permit to be sold or delivered, any
garbage to any person, firm or corporation that disposes of or will
dispose of the same within the corporate limits of said city, and
any such permit may be revoked j4nd annulled at any time by the Board
of Trustees of said city.
SECTION 4.
No permit shall be grented to any person, firm or cor-
poration to remove garbage from more than one house or place of bus-
iness, and no permit granted pursuant to the provisions of this ordin-
ance shall be assigned or transferred without the consent of the Board
of Trustees of the City of Anaheim, entered upon the minutes of said
Board, and no permit shall be issued for a period of longer than three
years.
SECTION 5.
In the event that any person, firm or corporation, hold-
ing a permit to remove or convey garbage upon or along any public
street, alley, highway or public place in the City of Anaheim, shall
violate or shall cause or permit to be violated any conditions of
such permit or any provisions of this Ordinance, or of any ordinance
to be hereafter enacted, relating to or regulatinit the collection,
removal or disposal of garbage, or shall reznove or convey, or shall
cause or permit to be removed or conveyed such garbage in an unlaw-

ful, improper or unsanitary manner, it shell be the duty of the
Board of Trustees of the City of Anaheim, in addition to the other
penalties provided by this Ordinance, to revoke such permit issued
to such person, firm or corporation. If the permit issued to any
person, firm or corporation pursuant to the provisions of this
Ordinance to remove or convey garbage, shall be revoked, no permit
shall thereafter be granted to such person, firm or corporation,
to remove or convey garbage.

It shall be unlawful for any person, firm or corpora-
tion to remove or convey or, to cause or permit to be removed or
conveyed, any garbage upon or along any pnblic street, alley, high-
way, or other public place in the City of Anaheim, except in water-
tight vessels, receptacles, tanks or wagon boxes constructed of
steel, galvanized iron, or other metallic substances and mounted
on wheels. Every such vessel, receptacle, tank or wagon box, while
the same contains garbage, shall.. be securely and tightly covered
and closed in such a manner as to prevent the contents thereof or
any odor from escaping therefrom. Every such vessel, receptable,
tank or wagon box shall be thoroughly cleansed daily, and disin--
fected at least once during each geek. :.very vehicle carrying
any such vessel, receptacle, tank or wagon box shall be so loaded
and driven that none of the contents thereof shall fall or escape
therefrom.
SECTION 7.
It shall be unlawful for any person, firm, or corpora-
tion holding a permit issued by the Hoard of Trustees of the City
of Anaheim, pursuant to the provisions of this Ordinance, to fail,
refuse or neglect to remove 0_1 garbage from the place in the ap-
plication designated for such permit, at least once in every eighty
hours.

SECTION B.
It shall be the duty of each owner or manager of
any boarding house, restaurant, hotel, or eating house, and of
every person occupying a dwelling within the City of Anaheim,
to provide or cause to be provided, and at all times to keep or
cause to be kept, portable vessels, tanks or receptacles for
holding garbage. Every such vessel, tank or recept able shall
be constructed of metal and shall be water -tight, and shall be
so constructed as to contain not less than three nor more than
sixteen gallons, and shall be provided with handles on the out-
side thereof, and with a tight fitting metal cover. Such cover
shall not be removed therefrom except when necessary to place
therein or to remove garbage therefrom, or when the same is being
cleansed. Every such vessel, tank or receptacle shall be kept
or placed in the following manner;
�',iYiere there is an alley in the rear of the premises of the
person using such vessel, tank, or other recept able, the same
shall be placed on the premises within five feet of the property
line of said alley;
When there is no alley in the rear of such premises, and
there is an alley or street along the side thereof, each vessel,
tank, or receptacle shall be placed on the premises at a point
in the rear of said lot or premises and adjacent to said alley
or street extending along the side thereof
Where there is neither alley nor side entrance, each such
vessel, tank or receptacle shall be placed in the rear of such
premises, at such place and in such manner as to be accessible
to any person licensed to collect garbage as herein provided, or
to any person with whom the City of Anaheim may have entered in-
to a contract for the disposal and disposition of garbage. After
any such vessel, tank or receptacle shall have been emptied by
the garbage collector, whether he be a person licensed to collect
garbage as herein provided, or a person with whom the City of Ana-
heim may have entered into a contract for the collection of gar-
bage, the same shall be returned by him without delay to the place
where same was found.
SECTION 9.
It shall be unlawful for any person, except the per-
son holding such permit for the collection of garbage, or a person
with whom the City of Anaheim has entered into a contract for the
collection, removal and disposal of garbage, to interfere in any
manner with any. vessel, tank, or receptacle or the contents there-
of, or to remove any such vessel, tank or receptacle from the lo—
cation where the same was placed by the owner thereof or to remove
the contents of any such vessel, tank or receptacle. It shall be
unlawful for any person to place, or cause or permit to be placed
in any such vessel, tank or receptacle, any substance other than

SECTION 10.
It shall be unlawful for any person, firm or cor-
poration to deposit or to c4use or permit to be depooited, any
street or
garbage upon or in any portion of y/ alley oz other public place
or upon any premises in the said. City of Anaheim.
SECTION 11.
Any person, firm or corporation violating any of
the provisions of this Ordinance shall be deemed guilty of a mis-
demeanor, and upon conviction thereof, shall be punished by a
fine not exceeding One Hundred Dollars, or by imprisonment in
the City Jail of said city for a period not exceeding fifty drys,
or by both such fine and imprisonment.
SECTION 12.
All ordinances and parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
SECTION 13.
The City Clerk of the City of Anaheim shall certify

to the passage of this Ordinance and cause the same to be pub-
lished once in the 'tAna.heim Gazette" a weekJ77 newspaper of gen-
eral circulation, printed, published and circulated in the said
city.
SECTION 14.
That for the reason that this Ordinance is pass-
ed for the immediate preservation of the public health, the
same shall take effect end be in full force from and after the
date of its publication as provided in Section 13 of this Ordin-
ance.
That the facts constituting the urgency of this Ordinance
are as follows; That there exists no effective ordinance in
the City of Anaheim, providing for the proper disposal of gar-
bage in said city, and there does not now exist any person,
firm or corporation licensed or authorized by said Cityto col-
lect and dispose of garbage within said City and that the ab-
sence of such effective ordinances and proper facilities for
removal and disposal of garbage constitutes a menace to the
public health of said city.
