ORDINANCE NO. 288
AN ORDINANCE PROVIDING FOR THE
ORGANIZATION OF A FIRE COM-
PANY IN AND FOR THE CITY OF
ANAHEIM AND PROVIDING FOR
THE GOVERNMENT THEREOF, AND
D
FOR THE CARE AND CUSTOY OF
FIRE FIGHTING APPARATUS OF
SAID CITY.
THE BOARD OF TRUSTEES OF THE
CITY Ob' ANAHEIM DO ORDAIN AS
FOLLOWS:
SECTION 1. That at any time after
this ordinance takes effect, not less than
twelve nor more than twenty citizens of
the City of Anaheim, may organize a
fire company in accordance with and in
the manner provided by Section 3335 of
the Political Code of the State of Cal-
ifornia, and any such fire company when
so organized shall be known as and des-
ignated "The Anaheim Fire Depart-
ment." The active membership of said
fire company shall not be less than
twelve nor more than twenty.
SECTION 2. The officers of such fire
company shall be a foreman, a chief, a
secretary and a treasurer and such other
subordinate officers and committees as
may be created or authorized by the by-
laws of such fire company.
SECTION 3. It shall be the duty of
the foreman of the fire company to pre-
side at all meetings thereof and to per-
form and discharge such other and ad-
ditional duties as may be imposed upon
him by law and by the by-laws of such
fire company.
SECTION 4. It shall be the duty of the
Secretary of such fire company to keep
a journal of all proceedings of the fire
company; to keep a true and accurate
roll of its active members and of all ex-
empt members thereof; to keep a cor-
rect and accurate account of all funds
belonging to said fire company and to
do and perform all other acts and things
which may be enjoined upon him by law
and by the by-laws of such fire com-
pany.
SECTION 5. It shall be the duty of the
treasurer to keep in his possession and
account for all moneys belonging to suh
fire company and to pay and disbursce
the same only on the warrant of the
foreman, countersigned by the secre-
tary of said fire company.
SECTION 6. It shall be the duty of
the chief of said fire company to en-
quire into the causes of every fire oc-
curring in said city and to keep a rec-
ord thereof. He must aid in the en-
forcement of all fire ordinances to be
enacted by the Board of Trustees of
said City; examine buildings in process
of erection; report violations of ordi-
nances relating to the prevention of ex-
tinguishments of fires and when directed
by the proper authorities, institute pro-
ceedings therefor; he must attend all:
fires with his badge of office conspicu-
ously displayed and must prevent in-
jury to, take charge of and preserve all
Property rescued from fires and return
the same to the owners thereof on the
payment of the expense incurred in sav-
ing and keeping the same. He shall
have command and control of said fire
company and the apparatus thereof while
the same is in service, and all officers
and members of said fire company shall
submit to his authority, and he shall
do and perform such other acts and
things as may be enjoined upon him by
law or by the by-laws of said fire com-
pany.
SECTION 7. Within thirty days after
the organization of said fire company,
said fire company shall adopt a code
of by-laws and regulations which sha11
not conflict with the laws of the State
of California, nor with any ordinances
of the City of Anaheim, provided, how-
ever, that before the said code of by-
laws shall take effect it shall be sub-
mitted to and be approved by the Board
of Trustees of the City of Anaheim.
SECTION 8. Within thirty days after
this ordinance takes effect, the Board of
Trustees of the City of Anaheim shall
appoint a driver of any motor fire -truck
now or which may hereafter be owned
or acquired by said City of Anaheim.
Such driver shall be a licensed chauffeur
as provided by the Motor Vehicle Act
of the State of California, and shall be
a competent mechanic and chauffeur,
and it shall be the duty of said driver
to operate said fire -truck and to keep
the same and the equipment appurtenant
thereto, in good order and repair.
Said driver or his assistants to be
hereafter appointed as hereinafter -pro
vided, shall at all times be on duty and
ready to respond to the alarms of fire.
The compensation of such driver shall
be Seventy-five (75) Dollars per month,
which shall be paid at the time and in
the manner and out of the same fund
that the wages of other employees of
said city are paid.
SECTION 9. The Board of Trustees
of the City of Anaheim may, from time
to time, appoint one or more assistants
to the driver of said motor fire -truck,
and may, by resolution, fix their com-
pensation. Such assistant or assistants
shall possess the same qualfiications as
the driver of said motor fire -truck, and
he or they shall assist him in the dis-
charge of his duties as herein prescribed,
and at all times, shall be under his di-
rection and control,
SECTION10. The Foreman, Chief,
Secretary, and Treasurer of said fire
company shall be elected by said fire
company annually at such times and in
such manner as may be provided by the
by-laws of such company, provided that
the election of the chief of said fire com-
pany shall not be effective until the
same is ratified and approved by the
Board of Trustees of the City of Ana-
heim.
SECTION 11. The 3oard of Trustees
of the City of Anaheim shall, at the first
meeting of the said Board of Trustees o
each and every month, pause a wartaot
to be drawn on the l'reasorer of said
city, signed by the President of its Board
of Trustees and countersigned by the
City Clerk of said city, in the ;um of
Sixty dollars which said ;um shall be
used by said fire company for the sup-
port and maintenance thereof in such
manner as may be provided by its by-
laws, to be approved by said Board of
'trustees as herein provided.
SECTION 12. All ordinances and parts
of ordinances in conflict with the pro-
visions of this ordinance, are hereby
repealed.
SECTION 13. The City Clerk of the
City of Anaheim shall certify to the pas-
sage of this ordinance and cause the
same to be published once in the Ana-
heim Gazette, a week:y newspape_ of
general circulation, printed, published
and circulated in said city and immedi-
ately thereafter, the same shall take ef-
fect and be in fuii force.
SECTION 14. That the public safety
requires the immediate passage of this
orainance. That the reason for the ur-
gency of the imrnadirte nassage thereof
is as follows: The ;ity -u .,a,i.hei,n has
ordered a certain motor fire -truck; chat
there is no provision by law or or,:i-
nance in said city providing for the prop-
er and efficient management and control
of such motor fire -track, and that the
public safety demands that this ordi-
nance should take effect immediately
after its passage and publication.
The foregoing ordinance is signed, ap-
proved ana attested by me this 8th day
of July, A. D. 1915.
