The Board of Trustees of the City of Anaheim do ordain as follows: SEC'I'iO11,1. The term "intoxicating liquor" as the same is used in this or- dinance, is defined to mean ang Spirit- uous, vinous, malt, oiled, or other in- toticating liquor, containing not Less than three per cent by volume of alcohol. The term "intoxicated person" as the same is used in this ordinance, is defin- ed to mean any person who has used in- toxicating liquor to such an extent as to have lost the normal control of such per- son's bodily and mental faculties or to evince a disposition to violence, quarrel- someness or bestiality. SECTION 2. It shall be unlawful for any person, firm, or corporation, engag- ed in the busineso of selling and serving, or giving away intoxicating liquors, to lie consumed upon the premises where the same are so sold, served, or given away, either as owner, proprietor, man- ager, servant or employee, or for any person, firm, or corporation, engaged in the business of operating or maintain- ing a hotel, restaurant or cafe engaged in the business of selling, serving, or giv- ing away intoxicating liquors, to guests or patrons of such hotel, restaurant or cafe, either as owner, manager, servant, employee, or otherwise, to sell, serve, or give away, within the City of Anaheim any intoxicating liquors to any intoxicat- ed person. SECTION 3. Any person, firm, or cor- poration who shall violate any of the pro- visions of this ordinance shall be deem- ed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than Three hundred dollars ($300.00) or by imprisonment in the City Jail of said city, for not more than ninety days, or by both such fine and imprisonment. SECTION 4. Should any court of com- petent jurisdiction declare any section, paragraph, sentence, clause or phrase of this ordinance to be unconstitutional, or invalid, such declaration or decision will nut affect the remaining parts of this or- ilinaace, and the Board of Trustees here- by declares that it would have passed this ordinance notwithstanding the fact that any such section, paragraph, sentence, clause, or phrase was so declared to be unconstitutional. SECTION 5. All ordinances and parts of ordinances in conflict with the pro- visions of this ordinance are hereby re- pealed. SECTION 6. The City Clerk of the City of Anaheim shall certify to the pas- sage of this ordinance, and cause the same to be published once in the Ana- heim Gazette a newspaper of general cir- culation, printed, published, and circu- lated in said city, and thirty days from and after its final passage it shall take effect and be in full force.
