The board of Trustees of the city of W do 7 Section 1 It shall be unlawful for any person, 8 firm or corporation, or any association or club, within the 9 City of Anaheim, to keepconduct or establish, either as prin- 10 cipal or agent, any places.Vhere alcoholic liquors are mann- 11 factured S;QSd served,- given away or distributed, or delivered`, 12 or received, or are kept for the purpose of sale, distribution; g 13 or to be served or given away, nor shall any such m o ; 14 alcoholic liquors be manufactured, sold or given away on or in mJ 15 any such place; or on or in any street; alley; park; vacant lot i or J o 1. is er PUb'li.s place within said city, except as provided in Section F o � 17 3 of this Ordinance, and every day that such place shall be 0 18 kept, established or conducted, shall constitute a separate 19 offense. 20 Sectio 2. Third. Fifth. The distributing of wine at the saeramental ser,vie,es of aur raligienz ' orgahization Sixth. The keeping of alcoholic liquors on the premises of registered pharmacists at their places of business, Seetion-:,;4. No physician shall give to,or write for, any well person, or persons, not in actual need of said liquor as a medicine, any prescription for alcoholic ligaors; either separately or compounded with other ingredients; and any physician who shall assist in violating or evading any of the provisions of this act; shall be guilty of a misdemeanor, Iand upon conviction thereof; shall be liable to the penalty 4 Tovij*4 ;in ,Section 9 hereof. Section 5. No person shall sell, give or furnish any vinous, maj.t or spiritous liquors or other alcoholic liquors to any person within said City of Anaheim, except as in this ordinance provided. Section b. All plaose where alcoholic liquors are sold or distributed, or are kept for sale or distribution, in violation of any of the provisions of this act, are hereby declere .to be common nuisances, and shell be abated as such, end it shall be the duty of the City Attorney,to take action to abate such nuisances. The payment of the Internal Revenue special tax, required of liquor dealers by the United States, by any person or persons; other than registered pharmacists; shall be prima facie evidence that such person or persons are keopi ng sass& selling alcoholic liquors in violation of this Ordinance; and in any prosecution under this Ordinance a certi- ficate from the Collector of Internal Revenue, or from any of his deputies or.Vents, shc�v�in�• th�.; �t. s nch t*.:Vx has )een i :_j t' by thedefea:.�i t, 41i .:rtc�x• <.lo :.Lone or T'i association with o there, shall be snf icientu evideiiee of the peW=nt of such. tax. Section 9. An person who violates any of the sionssr of this Ordinance shall be guilty of a misdemeanor; Mid upon oonviction thereof, shall be punished by a fine of not more than three hundred dollars, or by imprisonment in tbo &p -o :tX �;adl, not exceeding three months, or by both such fine and imprisonment; but any person found guilty of violating any of the provisions of this Ordinance by conviction of an offense committed after a previous conviction under this Ordinance", stall be punished by a fine not exceeding three hundred dollars, nor less than one hundred dollars, and by imprisonment in the County Zail not exceeding three months; nor less than one month. Section to All ordinances or parts of ordinances of the City of Anaheim in conflict with the provisions of this ordinance are hereby repealed. Section 11, The City Clerk shall certify to the passage of this ordinance and cause' the same to be published in the Anaheim Weekly Gazette`, and thereafter, to -wits at twelve o'clock midnight, September 30, 191801 the same shall be in force and effect.
