97-217RESOLUTION NO. 97R- 217 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION, GENERAL EMPLOYEES, CLERICAL EMPLOYEES, AND THE CITY OF ANAHEIM WHEREAS, the Human Resources Director met and conferred with officials and employee representatives of the Anaheim Municipal Employees Association, General Employees and Clerical Employees, relating to the effects of the City of Anaheim contracting out Information Services to SCT; and WHEREAS, as a result thereof, the Letter of Understanding dated October 24, 1997, between the parties has been prepared and signed; and WHEREAS, the Union is in agreement with the recommendations contained in said Letter of Understanding; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated October 24, 1997 between the Anaheim Municipal Employees Association, General Employees and Clerical Employees, and the City of Anaheim, a copy of which is attached hereto and incorporated be reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 18th day of November, 1997. CITY CLERK OF THE CITY OF ANAHEIM APPROVED AS TO-FORM: i_ y ,r>CITY ATTORNEY OF THE CITY OF ANAHEIM o,neor,uon,ctn eeoeo,erl oecnn AGREEMENT BETWEEN THE ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION GENERAL EMPLOYEES, CLERICAL EMPLOYEES AND THE CITY OF ANAHEIM The City of Anaheim "CITY and the Anaheim Municipal Employees Association "AMEA have met and conferred regarding the effects on the AMEA and the Information Services employees represented by AMEA of any determination by the CITY to contract with a vendor to provide information services to the CITY. The parties agree to the following provisions: Any employee who transitions directly from CITY to the vendor, or is laid off, shall, for the sole purpose of establishing eligibility for coverage under the City's post- retirement medical program, receive up to three (3) full years service credit subject to the following conditions and limitations: a) An employee who applies for and receives a PERS retirement shall have three (3) full years of service credit added to their City of Anaheim service for the purpose of determining their CITY retired medical benefit percentage. The benefit level shall be frozen and shall be used to determine the employee's CITY post- retirement medical coverage level upon retirement. b) Eligibility for post- retirement medical coverage shall require the employee to apply for and receive a PERS retirement. Such post- retirement medical coverage must be applied for within thirty (30) days of the effective date of a PERS retirement. Failure to exercise eligibility options within the specified time period shall be conclusively deemed abandonment of any right or entitlement under the City's post- retirement medical plan. 2. The CITY and AMEA agree to maintain an open line of communication to facilitate implementation of this Agreement. Any issue concerning this agreement may be discussed by AMEA or CITY at either party's request under the provisions of Article 11 (Discussion) of the Memorandums of Understanding. 3. The CITY and AMEA agree that any alleged violation of this Agreement shall be considered to be a matter subject to review through the grievance procedure and settled in accordance with the provisions of Article 49 (Grievance General) of the Memorandums of Understanding. 10/28/97 1 4. Nothing in this Agreement, or the discussions leading up to it, shall prejudice or compromise the respective positions of the CITY and AMEA concerning the propriety of any City action to contract out (information services) work. The CITY and AMEA agree that the provisions of this Agreement are not intended to conflict with the provisions of the existing Memorandums of Understanding between the Anaheim Municipal Employees Association (General Employees and Clerical Employees) and the City of Anaheim, except where explicitly stated in this Agreement.
