A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF ELECTRICITY AS ADOPTED BY RESOLUTION
NO. 71R-478 AND MOST RECENTLY AMENDED BY RESOLUTION NO.
200R-256.
WHEREAS, the City of Anaheim (Anaheim) maintains an electric
generation and distribution system for the distribution of
electricity to residents and inhabitants of Anaheim and has
adopted Rates, Rules and Regulations for the sale and
distribution of electricity; and
WHEREAS, the Anaheim Municipal Code authorizes the City
Council to approve reasonable Rates, Rules and Regulations
governing electric service and fees for providing electric
service; and
WHEREAS, sound financial operation of the Public Utilities
Department requires collection of adequate revenue for operation
and maintenance of the electric generation and distribution
system; and
WHEREAS, the Public Utilities General Manager has determined
that substantial changes have occurred in power supply costs
which have resulted in costs which exceed the costs included in
the existing base rates for electric service; and
WHEREAS, activation and setting of the Power Cost Adjustment
Billing Factor (PCABF) in accordance with the provisions of
Schedule PCA of the Electric Rates, Rules and Regulations will
maintain the financial integrity of the Public Utilities
Department by ensuring collection of adequate revenue for
operation and maintenance of the electric generation and
distribution system; and
WHEREAS, the Public Utilities Department has provided notice
to the Public Utilities Board and the City Council of the
proposed activation and setting of the PCABF; and
WHEREAS, the City Council finds and determines that
activation and setting of the PCABF as set forth in Appendix A
hereto is reasonable; and
WHEREAS, the City Council further finds and determines that
activation and setting of the PCABF in accordance with Schedule
PCA of the Electric Rates, Rules and Regulations is exempt from
the California Environmental Quality Act pursuant to Section
21080(b) (8) of the California Public Resources Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim as follows:
1. That the Power Cost Adjustment Billing Factor shall be,
and is hereby, activated and set as set forth in Appendix A
hereto and shall be effective March 6 , 2001.
2 That the Public Utilities General Manager is authorized
and directed to prepare, promulgate, publish and take all actions
necessary to activate and set the Power Cost Adjustment Billing
Factor in accordance with Schedule PCA of the Electric Rates,
Rules and Regulations as set forth herein.
