6154FOLLOWS: ORDINANCE NO. 6154 AN URGENCY ORDINANCE OF THE CITY OF ANAHEIM FIXING AND LEVYING A PROPERTY TAX ON THE FULL CASH VALUE OF ALL PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF ANAHEIM FOR THE FISCAL YEAR 2009/2010 AND DECLARING THE URGENCY THEREFOR AND THAT THIS ORDINANCE SHALL TAKE IMMEDIATE EFFECT. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That pursuant to Section 93 of the Revenue and Taxation Code of the State of California there be, and is fixed and levied, a property tax rate for the fiscal year 2009/2010 of .00215 percent of full value on all real and personal property within the corporate limits of the City of Anaheim, for the purpose of paying the annual interest on bonds and such part of the principal as will become due before the proceeds of the next general tax levy will be available. The amount of funds to be generated from taxable property within the City of Anaheim as revenue to pay the voter approved indebtedness from this action is the sum of $646,129.00. SECTION 2. That the City Clerk of the City of Anaheim shall certify to the County Auditor of Orange County, the foregoing distribution of the tax rate of the City of Anaheim to be extended by him on the 2009/2010 County Assessment Roll for the collection thereof in the same manner as County taxes. SECTION 3. DECLARATION OF URGENCY That this ordinance is hereby declared to be necessary as an emergency measure for the immediate preservation of the public peace, health or safety which shall be in full force and effect immediately upon its adoption pursuant to Section 511 of the City Charter. A statement of the reasons for such urgency is: 1. The Anaheim City Charter requires that the City Council fix the rate and levy taxes each year. 2. The required financial data necessary to allow the City to determine the tax rate were not received by the City until August 10, 2009. The last meeting of the City Council prior to the deadline for adoption of such ordinance is August 25, 2009. 4. Failure to adopt the tax rate and levy taxes within the time provided by law would result in insufficient revenues in fiscal year 2009/2010 to meet necessary obligations. The adoption of this ordinance as an emergency measure is therefore necessary for the immediate preservation of the public peace, health or safety. SECTION 4. DECLARATION OF IMMEDIATE EFFECT That pursuant to the provisions of Paragraph (c) of Section 514 of the Charter of the City of Anaheim, this Ordinance shall take effect and be in full force immediately upon and after its adoption. SECTION 5. That the City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City.
