A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT
LOCATED UPON ASSESSOR PARCEL NUMBER 272 -08105
PURSUANT TO CALIFORNIA STREETS AND HIGHWAY
CODE SECTION 8330, ET SEQ. SUMMARY VACATION.
(Abandonment No. ABA 2009- 0000198)
WHEREAS, an applicant has requested the vacation of a public utility easement,
located upon Assessor Parcel Number 272- 081 -05, in order to clear title to the land for the
facilitation and development of a 52unit multi family affordable housing project; and
WHEREAS, the easement to be vacated is not necessary for present or prospective
public utility purposes: and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities
and there are no other public facilities located within the easements.
NOW, 'THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public utility easement upon Assessor Parcel Number
272 081 -05. as set forth in a Partnership Easement Deed recorded January 18, 1990 as Instrument
Number 90- 02994. of Official Records, as shown in Exhibit "A attached hereto and incorporated
herein by this reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed. to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easement.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not he effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
Orange County.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 1 st day of September 2009, by the following roll call vote:
AYES: Mayor Pringle, Council Members Hernandez, Sidhu, Galloway, Kring
