RESOLUTION NO. 2007R- 004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT AND
A STORM DRAIN EASEMENT LOCATED AT 1515 KATELLA
AVENUE PURSUANT TO CALIFORNIA STREETS AND
HIGHWAYS CODE SECTIONS 8330 ET SEQ.- SUMMARY
VACATION (Abandonment No. ABA 2006 -00139.)
WHEREAS, an applicant has requested the vacation of a public utility easement and
a storm drain easement located at 1515 Katella Avenue, Anaheim, California in order to clear title
to the land and facilitate the development of 320 apartment units, pursuant to Building Plan BLD
2006 01225;
WHEREAS, the public utility easement and storm drain easement to be vacated are
no longer required for present or prospective public utility purposes /storm drain purposes; and
WHEREAS, the public utility easement and storm drain easement to be abandoned
are superseded by the relocation of the easements; and
WHEREAS, there are no other public facilities located within the public utility
easement and storm drain easement; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public utility easement and storm drain easement
reserved in a Corporation Easement Deed recorded as instrument number 91- 467071 of Official
Records, Orange County, State of California, as shown in Exhibit "A" and, attached hereto and
incorporated herein by this reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete, and the public service easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 9th day of January 2007, by the following roll call vote:
AYES: Mayor Pringle, Council Members Sidhu, Hernandez, Galloway, Kring
