A RESOLUTION OF THE CITY OF ANAHEIM APPROVING AND
AUTHORIZING EXECUTION OF AN AMENDMENT TO THE
JOINT EXERCISE OF POWERS AGREEMENT FOR COOPERATIVE
PERSONNEL SERVICES (CPS)
WHEREAS, the State of California, acting through and by the State Personnel
Board in connection with its functions related to local government, the Counties of Sacramento
and Sonoma, the Hayward Unified School District, the City of Anaheim, the East Bay Municipal
Utility District, the City and County of San Francisco, the City of Las Vegas, the State of
Wisconsin, Office of Employment Relations, and the City University of New York are parties to
that certain Joint Exercise of Powers Agreement, Cooperative Personnel Services (the
"Agreement dated for convenience as of March 15, 1985, as amended; and
WHEREAS, Cooperative Personnel Services "CPS is a joint powers agency
established to assist the parties in their efforts to develop and implement modern human
resource and related management procedures; and
WHEREAS, as provided under the Agreement, the Board of Directors of CPS
consists of one representative from each of the parties to the Agreement; and
WHEREAS, the Board of Directors, at its meeting of September 8, 2006,
approved certain amendments to the Agreement (the "Amendment to, among other things,
identify the current members of the Board of Directors, expand and clarify the purpose of CPS,
and make other clarifying and conforming changes; and
WHEREAS, Section 17 of the Agreement provides that the Agreement may be
amended by the concurrence of all parties to the Agreement;
NOW, THEREFORE BE IT RESOLVED that the City of Anaheim hereby
approves the proposed Amendment to the Agreement in substantially the form attached hereto
and incorporated herein by reference.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and
directed to execute the Amendment on behalf of the City of Anaheim, subject to any minor,
clarifying or conforming changes approved by the City of Anaheim City Attorney.
