RESOLUTION NO. 2007R- 013
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING TWO PUBLIC UTILITY EASEMENTS
LOCATED AT 1830 WEST CRESCENT AVENUE PURSUANT
TO CALIFORNIA STREETS AND HIGHWAYS CODE
SECTIONS 8330 ET SEQ.- SUMMARY VACATION
(Abandonment No. ABA 2007 00146.)
WHEREAS, an applicant has requested the vacation of two public utility easements
located at 1830 West Crescent Avenue, Anaheim, California in order to clear title to the land and
facilitate the development of sixty -three (63) affordable rental units, pursuant to Building Plans
BLD2007 -00068 through BLD2007- 00074; and
WHEREAS, the public utility easements to be vacated are no longer required for
present or prospective public utility purposes; and
WHEREAS, the public utility easements to be vacated are superseded by the
relocation of the public utility easements; and
WHEREAS, there are no other public facilities located within the public utility
easements; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public utility easements reserved in an Easement
Deed recorded as Instrument Number 31583, in Book 10299, Page 913 of Official Records of
Orange County, State of California, as shown in Exhibit "A" and, attached hereto and incorporated
herein by this reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete, and the public service easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 3Otiday of January 2007, by the following roll call vote:
