A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT
LOCATED ON APN 255- 022 -63, GENERALLY LOCATED AT
THE CORNER OF LINCOLN AVENUE AND WILSHIRE
AVENUE, PURSUANT TO CALIFORNIA STREETS AND
HIGHWAYS CODE SECTIONS 8330 ET SEQ.- SUMMARY
VACATION (Abandonment No. ABA 2006 00144.)
WHEREAS, an applicant has requested the vacation of a public utility easement
located on APN 255- 022 -63, generally located at the corner of Lincoln Avenue and Wilshire
Avenue, Anaheim, California in order to clear title to the land and facilitate the development of
twenty -five (25) affordable rental units; and
WHEREAS, the public utility easement to be vacated is no longer required for present
or prospective public utility purposes; and
WHEREAS, the public utility easement to be vacated is superseded by the relocation
of the public utility easement; and
WHEREAS, there are no other public facilities located within the public utility
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public utility easement reserved in a Partnership
Easement Deed recorded as Instrument Number 89- 281878 of Official Records of Orange County,
State of California, as shown in Exhibit "A" and, attached hereto and incorporated herein by this
reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete, and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheimthis 13thday of February 2007, by the following roll call vote:
