WHEREAS, an applicant has requested the vacation of two public utility easements located at 1045 North Kemp Street, Anaheim, California in order to clear title to the land and facilitate the development of new commercial buildings, pursuant to Building Plan BLD2006 -0045 8; and WHEREAS, the public utility easements to be vacated are no longer required for present or prospective public utility purposes; and WHEREAS, the public utility easements to be vacated are superseded by the relocation of the public utility easements; and WHEREAS, there are no other public facilities located within the public utility easements; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of the public utility easements reserved in a Corporation Easement Deed recorded as Instrument Number 15089 in Book 7560, Page 198 of Official Records of Orange County, State of California, as shown in Exhibit "A" and, attached hereto and incorporated herein by this reference. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of the County of Orange. BE IT FURTHER RESOLVED that from and after the date the certified copy of this Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be complete, and the public service easements vacated shall no longer constitute public service easements.
