A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF FIVE FOOT PUBLIC
UTILITY EASEMENT LOCATED UPON PARCEL NUMBER
082 -341 -22 PURSUANT TO CALIFORNIA STREETS AND
HIGHWAY CODE SECTION 8330, ET SEQ. SUMMARY
VACATION. (Abandonment No. ABA 2009 00194)
WHEREAS, an applicant has requested the vacation of a portion of a five foot
easement for public utility purposes lying within Lot 10 of Tract No. 2005, located upon Parcel
Number 082 341 -22in Anaheim, California, in order to clear title to the parcel of land and allow for
development of a single family home: and
WHEREAS, the public utility easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities
and there are no other public facilities located within the easement; and
NOW, THEREFORE. BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order vacation of a portion of a five foot public utility easement lying within
Lot 10 of Tract No. 2005, as per the map recorded in Book 56, Pages 43 and 44 of Miscellaneous
Maps of Official Records, Orange County, State of California and more particularly described in
Exhibits "A' and "B" attached hereto
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed. to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the Count) of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 31st day of March 2009, by the following roll call vote:
