RESOLUTION NO. 2007- 078 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING AND RESTATING CITY COUNCIL POLICIES AND MEMORIALIZING SAID POLICIES IN A CITY COUNCIL POLICY MANUAL WHEREAS, the City Council of the City of Anaheim has heretofore adopted certain written policies which policies have been collected and organized in a document entitled the "Council Policy Manual;" and WHEREAS, over the course of time, certain of said policies have become outdated, and certain other of said policies are in need of amendment; and WHEREAS, the City Council desires to rescind certain of said policies, to adopt, amend and/or restate all of the current written policies of the City Council, and to memorialize all of said current written policies of the City Council as so adopted, amended or restated in a revised and restated document entitled the "Council Policy Manual." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: That the City Council does hereby rescind any and all written policies heretofore adopted by the City Council including, but not limited to, those certain policies heretofore adopted and contained in that certain collection of policies entitled "Council Policy Manual" as the same exists at the time of adoption of this resolution. That the City Council does hereby adopt each of those certain policies set forth on Exhibit A attached hereto and incorporated herein by this reference as if set forth in full (the "Revised Policies That the City Council does hereby direct the City Clerk to memorialize and organize the Revised Policies in both electronic and hard copy loose -leaf book formats in a document entitled "Council Policy Manual" and to publish, distribute and otherwise make said Council Policy Manual available for official business purposes and for public information and review. 1 That said Council Policy Manual, and each policy contained therein, shall remain in full force and effect, notwithstanding any changes in membership of the City Council, unless and until said Council Policy Manual, or any of the policies contained therein, is expressly rescinded or amended by resolution of the City Council. Upon the future adoption, amendment or rescission of any policy by City Council resolution, the City Clerk is directed to immediately memorialize said action by revising the Council Policy Manual in the manner necessary to reflect said action and to give notice thereof in such manner as the City Clerk may deem appropriate. The policies set forth in the Council Policy Manual, as the same may be revised, amended or supplemented from time to time, shall be deemed directory. Compliance with the provisions of any such policy may be formally waived from time to time by a motion duly adopted by a majority of a quorum of the City Council. Whether or not formally waived, failure to comply with the provisions of any such policy shall not be deemed a violation of any law nor be the basis for any civil or administrative action against the City, any City officer or employee or any other person or entity.
