RES-2009-019RESOLUTION NO. 2009- 019 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 2008 -110 RELA TO FEE AND RATE SCHEDULES FOR BUILDING, CONSTRUCTION. GEOGRAPHIC INFORMATION SYSTEM (GIS), AND NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS, SERVICES AND ACTIVITIES. WHEREAS, Section 15.02.070 of the Anaheim Municipal Code and the provisions of state law authorize the City Council to establish fees and rates of charges for the purpose of defraying the costs and expenses to the City of Anaheim of permits, inspections, re- inspections and other services and activities relating to the Anaheim Building Codes pertaining to the regulation of building and construction activities, permits and activities subject to National Pollutant Discharge Elimination System "NPDES requirements. and Geographic Information System (GIS) services (hereinafter collectiveh the `'regulated activities and WHEREAS, the City Council has heretofore adopted Resolution No. 2008 -110 establishing fees and rates of charges relating to the regulated activities; and WHEREAS. the Legislature of the State of California enacted Senate Bill 1473 Calderon), codified as California Health and Safety Code Sections 18930.5, 18931.6, 18931.7 and 18938.3, which requires cities and counties to collect, on behalf of the California Building Standards Commission. a fee from building permit applicants based on building valuation to fund development of statewide building standards, with emphasis on green building standards; and WHEREAS, the City Council hereby finds and determines that this resolution establishing and /or amending the fees and rates of charges for the regulated activities in the manner hereinafter set forth is exempt from the provisions of the California Environmental Quality Act pursuant to Section 21 080 (b) (8) of the California Public Resources Code; and WHEREAS, said fees and rates as hereinafter set forth have been considered at a duly noticed public hearing as required by law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Exhibit "B" referred to and adopted pursuant to Section 1, Paragraph A, of Resolution No. 2008-110 be. and the same is hereby, amended as follows: 1. The fees and hourly rates set forth in Exhibit "B" attached hereto shall be, and the same are, hereby adopted. 2. The fees and hourly rates established herein shall become effective sixty (60) days following the date of adoption of this Resolution. 3. The fees and hourly rates established herein shall, upon the effective date of said fees and rates, supersede fees and hourly rates set forth in Exhibit "B" referred to and adopted pursuant to Section 1, Paragraph A, of Resolution No. 2008 -110 and any previously adopted fees and rates for the same permit or approval. 4. The City Council hereby declares that should any one or more fees established by this Resolution or any portion of this Resolution be declared for any reason to be invalid, it is the intent of the City Council that it would have adopted all other fees and portions of this Resolution independent of the elimination herefrom of any such fee or such portion as may be declared invalid. BE IT FURTHER RESOLVED that except as amended herein Resolution No. 2008- 1 10 shall remain in full force and effect.
