A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE CONVEYANCE BY GRANT
DEED OF THE CITY'S RIGHT, TITLE AND INTEREST IN A
PORTION OF WEST WATER STREET AND SOUTH WEST
STREET(City Deed No. 11287)
WHEREAS, the City of Anaheim "City wishes to convey to Raymond Levert
"Grantee that certain real property, described as a portion of West Water Street and South West
Street. as described in Exhibit "A" and depicted in Exhibit "B attached hereto and incorporated
herein by this reference; and
WHEREAS. on July 15, 2008, the City Council of the City of Anaheim approved the
summary vacation of the Property due to realignment of South West Street and West Water Street by
California Department of Transportation "Caltrans and
WHEREAS, due to Caltrans realignment of South West Street and West Water Street,
excess surplus containing four parcels of land were combined under Lot Line Adjustment Number
0000566 and as a result. excess right -of -way was created, which is of no use or little value to the City;
and
WHEREAS, City desires to convey the Property to Grantee, the adjacent property
owner. due to parcel's constraint and configuration; and
WHEREAS. no permanent structures shall be constructed on the Property and further,
the Property shall be conveyed with reservations for public utility easement; and
WHEREAS, the City Council of the City of Anaheim does hereby find and determine
it is in the best interests of the City of Anaheim to convey the City's right, title and interest in the
Property
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Anaheim
that the Property described as that portion of West Water Street and South West Street, in the City of
Anaheim, County of Orange, State of California, as shown on Tract No. 335 Recorded in Book 15,
Page 11 of Miscellaneous Maps, and Tract No. 1400, recorded in Book 42, Pages 14 and 15 of
Miscellaneous Maps. in the Office of the County Recorder of the County of Orange depicted on
attached as IT:xhibit "A be and is hereby conveyed to the Agency by grant deed, reserving to the City
a permanent easement for public utility purposes, as described within Exhibits "A" and "B" attached
hereto.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 19tiay of MaY 2009, by the following roll call vote:
