A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE PUBLIC WORKS
DIRECTOR OR HER DESIGNEE TO SUBMIT A GRANT
APPLICATION ON BEHALF OF THE CITY OF ANAHEIM
TO THE COUNTY OF ORANGE, FOR GRANT FUNDING
FOR THE REGIONAL RECYCLING AND WASTE
DIVERSION GRANT PROGRAMS AND RECOGNIZING
THE COUNTY OF ORANGE FOR ITS REGIONAL
LEADERSHIP IN SOLID WASTE MANAGEMENT, AND IF
AWARDED, AUTHORIZING THE ACCEPTANCE OF
SUCH GRANT ON BEHALF OF THE CITY AND
AMENDING THE BUDGET FOR FISCAL YEAR 2009 -10
ACCORDINGLY.
WHEREAS, the County of Orange authorizes OC Waste Recycling "the Grantor
to administer various Grant Programs in furtherance of the State of California's (the "State efforts
to reduce. recycle and reuse solid waste generated in the State thereby preserving landfill capacity
and protecting public health and safety and the environment; and
WHEREAS, in furtherance of this authority, Grantor is required to establish
procedures governing the application, awarding and management of the grants; and
WHEREAS. grant application procedures require an applicant's governing body to
authorize by resolution its approval for submittal of the grant application identified below and the
designated individual authorized to execute all grant documents on behalf of the City of Anaheim
(the "City and
WHEREAS, the County of Orange has heretofore invited public agencies, including
the City, to submit applications to the Grantor for the Regional Recycling and Waste Diversion Grant
Program (the "Grant and
WHEREAS, the City of Anaheim desires to submit an application to Grantor for said
WHEREAS, the City is familiar with the terms, conditions and limitations of any
such Grant; and
WHEREAS, the City is willing and able to conform to each of the terms, conditions
and limitations imposed upon any such Grant to the City and is willing to enter into a Grant
agreement with Grantor for implementation of said Grant; and

WHEREAS, the City desires to accept any such Grant which may be awarded to the
WHEREAS, the City Council desires to amend the annual budget of the City to
reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations
and expenditures in the appropriate City program to reflect such award.
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Anaheim Public Works Director, or her designee is hereby authorized to
submit a grant application for and on behalf of the City of Anaheim, a public
entity established under the laws of the State of California, to County of
Orange OC Waste and Recycling for all grants which City is eligible.

The City Council of the City of Anaheim hereby agrees to, and this
resolution, does accept any such Grant so awarded to the City of Anaheim
without further action of the City Council being required therefor.
3. The City of Anaheim hereby agrees to comply with each and all of terms,
conditions and limitations imposed by the Grantor upon said Grant, and the
Anaheim Public Works Director or her designee is hereby authorized and
directed to execute any and all Grant documents including but not limited to,
applications, agreements, amendments, requests for payment, or other
documents as may be necessary in connection with the acceptance of said
Grant and as may be required by the Grantor to secure the Grant funds, and to
implement the approved Grant project, if such Grant is awarded to the City.
4 The City of Anaheim recognizes the opportunity the County of Orange has
provided through this Grant program and commends the County of Orange
for its regional leadership in solid waste management and recycling and waste
diversion activities throughout the County of Orange.
5. The annual budget of the City of Anaheim for fiscal year 2009 -10 is hereby
amended by increasing the appropriations and authorized expenditures in the
amount of Grant funds to be received by the City.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 19thday of MAY 2009, by the following roll call vote:
