A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF A PUBLIC UTILITY
BLANKET EASEMENT LOCATED OVER A PORTION OF
SOUTH STREET PURSUANT TO CALIFORNIA STREETS
AND HIGHWAY CODE SECTION 8330, ET SEQ.
SUMMARY VACATION. (Abandonment No. ABA 2009 00202)
WHEREAS, an applicant has requested the vacation of a portion of a public utility
blanket easement, reserved unto the City of Anaheim in Resolution 2007 -137 and recorded August
9. 2007. as instrument number 2007000498735 of Official Records, in order to facilitate the
development of several remnant parcels and as part of a condition of approval for PM2008 -188; and
WHEREAS, the blanket easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the blanket easement to be vacated is superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE. BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public utility blanket easement reserved unto the City
of Anaheim in Resolution 2007 -137 and recorded August 9, 2007 as Instrument No. 2007000498735
of Official Records.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed. to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not he effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
Orange County.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of _Anaheim this 1 st day of September 2009, by the following roll call vote:
