RESOLUTION NO. 2009 -149
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING RIGHT -OF -WAY AND EASEMENT
FOR STREET AND PUBLIC UTILITY PURPOSES PURSUANT
TO CALIFORNIA STREETS AND HIGHWAY CODE SECTION
8330, ET SEQ. SUMMARY VACATION (ABANDONMENT
NO. ABA 2009- 00197).
WHEREAS, an applicant, the California Department of Parks and Recreations, has
requested the vacation of right -of -way and easement for public street and public utility purposes
located as more particularly described in Exhibit A attached hereto and incorporated herein by this
reference (the "easement to clear title to State -owned land to help facilitate certain improvements
in conjunction with a proposed residential development on adjoining land owned by RRM
Properties. Ltd., as more fully set forth in Tentative Tract Map No. 17289; and
WHEREAS, the easement to be vacated is not necessary for present or prospective
roadway or public utility purposes; and
WHEREAS, the easement to be vacated has not been used for the purpose for which
it was dedicated or acquired for five consecutive years immediately preceding this proposed
vacation: and
WHEREAS. no public money has been expended for maintenance on the easement
during the five year period immediately preceding this proposed vacation.
NOW, THEREFORE. BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the right -of -way and easement for public street and
public utility purposes as more particularly described in Exhibits A attached hereto and incorporated
herein by this reference
BE IT F1 JRTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed. to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the easement vacated shall no longer constitute right -of -way and easement for public
street and public utility purposes.

storm sewers, sanitary sewers and water pipe lines dedicated to the City of Anaheim in
the Irrevocable Offer of Dedication of Right of Way recorded February 14, 1996 as
Instrument No. 19960068732 of Official Records in the office of the County Recorder
of said County, lying within Parcel 1 of Lot Line Adjustment LL 85 -22 recorded
August 15. 1985 as Instrument No. 85- 304375 of said Official Records.
