RES-2009-112RI SOI,I-Li'ION NO. 2009- 112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING 1HE AMOUNT OF THE PARK- IN-11E11 FEE AND RESCINDING RESOLUTION NO. 2008 -105 WHEREAS. the Cif:‘ Council has heretofore adopted and amended Sections 17.08.240, 1 7.08.250. 17.08.260. 17.34.010. 17.34.020, and 17.34.030 of the Anaheim Municipal Code establishing a formula for determining maximum park and recreation land dedication or in -lieu fees for the City of Anaheim: and WHEREAS. the following fees to be charged do not exceed the actual cost of acquisition and development of parks in the City of Anaheim and do not exceed the maximum fees authorized pursuant to said sections of the Anaheim Municipal Code; and WHEREAS, the City Council hereby finds and determined that the average cost of park development is Two Hundred Five Thousand, Five Hundred Four Dollars and Eighty -Nine Cents ($205.504.89) per acre and the average cost of park land acquisition is One Million, One Thousand, Eight Hundred Eighty Dollars ($1,001.880.00) per acre; and WHEREAS, in accordance with this formula. the park in lieu fees for single family apartment units and mobile homes would range from Eight Thousand Five Hundred Ninety -Six Dollars and Fifty -Eight Cents ($8.596.58) through Six Thousand Sixty -One Dollars and Seven Cents $6,061.07): and WHEREAS, the City Council believes it is in the best interests of the City of Anaheim and in concert with the desire of the City Council to maintain a stable economic environment that the park in Iicu fees for fiscal year 2009 -2010 should not increase above the prior fiscal year NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Anaheim that the park in -lieu fee to he paid as a condition of development of each residential unit is: Single Family Detached Units: $6.936.46 Single Family Attached Units: $5.388.14 Apartment Units 2 to 4 Units: $6,998.39 Apartment Units 5 or more Units: $5,408.78 Mobile liome Unit: $4,149,49 BE IT FI RTHER RFSOLVI'D that this Resolution shall become operative sixty (60) days following its date of adoption. BE IT 1'U R ':R RI SOLV I D that Resolution No. 2008 -105 shall be rescinded upon the operative date of this Resolution.
