RES-2007-133WHEREAS, Section 518 of Title V of the Charter of the City of Anaheim provides that, by ordinance or resolution, the City Council may authorize the City Manager to bind the City, with or without a written contract, for the acquisition of equipment, materials, supplies, labor, services or other items included within the budget approved by the City Council, and may impose a monetary limit upon such authority; and WHEREAS, pursuant to said Charter Section 518, the City Council desires to grant authority to the City Manager to enter into agreements so long as the amount of each contract does not exceed $100,000.00, exclusive of any contingent liabilities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby authorize the City Manager to bind the City for the acquisition of equipment, materials, supplies, labor, consultant services or other items for which funds are available within the budget approved by the City Council, provided said agreements do not exceed the sum of $100,000.00, exclusive of any contingent liabilities, including but not limited to indemnification provisions, which may be included in such agreements. BE IT FURTHER RESOLVED that the authority granted herein shall not apply to Public Works agreements entered into pursuant to City of Anaheim Charter Section 1211. AND BE IT FURTHER RESOLVED that Resolution No. 2004R -63 be, and the same is hereby, rescinded.
