A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING THREE PUBLIC UTILITY EASEMENTS
LOCATED AT 401 CARL KARCHER WAY PURSUANT TO
CALIFORNIA STREETS AND HIGHWAY CODE SECTION 8330,
ET SEQ. SUMMARY VACATION. (Abandonment No. ABA
2007 00157)
WHEREAS, an applicant has requested the vacation of three public utility easements
located at 401 Carl Karcher Way, Anaheim California, in order to clear title to the land and facilitate
the development of a new commercial office building pursuant to BLD 2007 00539; and
WHEREAS, the public utility easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities
and there are no other public facilities located within the easement.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of three public utility easements as set forth in an easement
deed recorded in Book 198 of Deeds, Page 74, an easement deed recorded January 7, 1914 in Book
244 of Deeds, Page 139, and in an easement deed recorded in Book 11502, Page 1430, of Official
Records, Orange County, State of California, as shown in Exhibit "A" attached hereto and
incorporated herein by this reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 21st day of August 200 7 by the following roll call vote:
