A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A DRAINAGE EASEMENT LOCATED
WITHIN ASSESSOR PARCEL NUMBER 085 581 -38 PURSUANT
TO CALIFORNIA STREETS AND HIGHWAYS CODE
SECTIONS 8330 ET SEQ.- SUMMARY VACATION
(Abandonment No. ABA 2007 00160)
WHEREAS, an applicant has requested the vacation of a drainage easement located
within Assessor Parcel Number 085 581 -38 in Anaheim, California as a condition to final approval
of Tentative Tract Map 16545 and in order to facilitate the development of 21 single family
detached homes;
WHEREAS, the drainage easement to be vacated is no longer required for present
or prospective drainage purposes; and
WHEREAS, the drainage easement to be abandoned is superseded by the relocation
of the easement; and
and
WHEREAS, there are no other public facilities located within the drainage easement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the drainage easement, reserved in a Grant Deed recorded
February 7, 1977, per Book 12062, Page 313 of Official Records, Orange County, State of
California, as shown in Exhibit "A" and, attached hereto and incorporated herein by this reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete, and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 21 st lay of August 2007, by the following roll call vote:
AYES: Mayor Pringle, Council Members Hernandez, Sidhu, Calloway, Kring
