RES-2007-232RESOLUTION NO. 2007 -232 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM SETTING FORTH LOCAL CONDITIONS JUSTIFYING AMENDMENTS TO THE 2007 EDITION OF THE CALIFORNIA FIRE CODE INCORPORATING BY REFERENCE THE 2006 INTERNATIONAL FIRE CODE WITH CALIFORNIA AMENDMENTS AS CODIFIED IN THE CALIFORNIA BUILDING STANDARDS CODE, PART 9, TITLE 24 OF THE CALIFORNIA CODE OF REGULATIONS. WHEREAS Section 17958.5of the Health and Safety Code permits the City to make changes or modifications to the 2007 California Fire Code, incorporating by reference the 2006 International Fire Code with California amendments, as codified within the California Building Standards Code, Part 9, Title 24 of the California Code of Regulations, (hereinafter "2007 California Fire Code as such changes or modifications are reasonably necessary because of local climatic, geographical or topographical conditions; and WHEREAS Section 13143.5of the Health and Safety Code permits a city, by ordinance, to make changes or modifications to the 2007 California Fire Code that are more stringent than the requirements published in the California Building Standards Code, Part 9, Title 24, of the California Code of Regulations, relating to fire and panic safety; and WHEREAS the City Council finds the approval of the subject amendments is exempt from the California Environmental Quality Act (CEQA) pursuant to Regulation No. 15061(b)(3), incorporated herein by this reference, which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment; and WHEREAS Sections 13143.5 and 17958.7 of the Health and Safety Code require the City, prior to adopting the ordinance, to make express findings that the adopted standards are reasonably necessary because of local climatic, geological or topographical conditions; and WHEREAS the Fire Chief of the City of Anaheim has recommended that the 2007 California Fire Code be adopted by the City with certain changes or modifications memorialized in Chapter 16.08 which are necessary to meet local climatic, geographical or topographical conditions. NOW THEREFORE BE IT RESOLVED that the modifications and changes recommended to the 2007 California Fire Code are reasonably necessary due to the following conditions: SECTION 1. The City Council finds the following local climatic, geographical and/or topographical conditions in the City of Anaheim justifying changes in the City's adoption of the 2007 California Code, as amended, and corresponding changes or modifications that are more stringent than the requirements published in the California Building Standards Code relating to fire and panic safety. 1 A. The entire City of Anaheim is located in an area which is subject to periodic wind conditions of extremely high velocity; the City is also subject to seasonal high temperatures and dry atmospheric conditions which often occur during times of those high velocity winds. B. These dry climatic conditions and winds contribute to rapid spread of fires originating in high- density housing. These conditions create a need for increased levels of fire protection. C. Traffic and circulation congestion is common throughout the City of Anaheim. This congestion often places at risk the fire department response time to fire occurrences, and makes it necessary to provide additional -fire protection systems to limit the exposure to death injury and property loss caused by fire, prior to the arrival of the fire department. D. The City of Anaheim is located in an area of substantial seismic activity. The Whittier/ Elsinore fault traverses the northeast section of the City; and the San Andreas fault is also expected to have a major impact on the City of Anaheim and poses a threat to life and property. It is believed these faults are capable of generating up to an 8.3 magnitude earthquake. Major earthquakes are accompanied by congested traffic flow and fires. During a major earthquake, fire department resources would be extremely taxed and the ability to respond to fires would be complicated and in some cases impossible. E. The climatic conditions described above are further accentuated by the topographical features of the hill and canyon area on the easterly portion of the city, south of the Riverside (SR- 91) Freeway and east of the Costa Mesa (SR -55) Freeway portions of which have been designated either as a "special protection area" or very high fire hazard severity zone. The "special protection area" and very high fire hazard severity zone are especially susceptible to fires which may spread quickly from one structure to another due to lack of shrub/brush clearance requirements, and other fire protection requirements needed to provide reasonable levels of fire safety. In the special protection area and very high fire hazard area zone, these conditions are further accentuated by steep canyons and draws, very steep road grades and dense vegetation which impede responding personnel and equipment. In order to provide reasonable levels of fire safety in the special protection area and very high fire hazard severity zone, more restrictive fire suppression and control safeguards are necessary. SECTION 2. The City Council further finds that to the extent that the modifications to the 2007 California Fire Code set forth in Chapter 16.08 of the Anaheim Municipal Code and the corresponding changes to the California Building Standards Code make changes or modifications that are more stringent than the requirements published in the California Fire Code and the California Building Standards Code relating to fire and panic safety, such modifications are required due to local climatic, geological and topographical conditions within the City of Anaheim, as set forth in attached Exhibit "A," titled "Building Standards Code Findings Matrix which exhibit is incorporated herein by this reference. SECTION 3. In order to correct existing conditions and prevent future conditions that are detrimental to the public health and safety and may result in serious injury, it is reasonably 2 necessary for the City of Anaheim to require the provisions of the 2007 California Fire Code as amended and adopted. SECTION 4. Of all means reasonably known to the City which could feasibly correct or avoid the injurious or detrimental condition, applying the requirements of the California Fire Code, 2007 Edition, with local amendments, to all areas of the City of Anaheim including those areas governed by development agreements, is the most reasonable means to protect the health, safety and welfare of the public. Failure to apply these provisions to all areas of the City of Anaheim, including those governed by development agreements, would result in conditions injurious or detrimental to the public health and safety. The application of these provisions is reasonably necessary to correct or avoid injuries or detrimental conditions. Consequently, the provisions of the California Fire Code, 2007 Edition, with amendments shall apply to all property located within the City of Anaheim, notwithstanding that such property may be the subject of development agreements which became effective prior to the date of adoption of the California Fire Code, 2007 Edition, with local amendments, and which contain any provision to the contrary. An Administrative Chapter was not included in the body of the model code. This amendment establishes clear procedures to enforce the Building Code. Most of the provisions were previously adopted in the prior building code. 2. 15.02.040.020 Administrative Code Existing Permit requirement for pool depth changed to 18 inches. This is an existing amendment addressing pool fencing to keep unsupervised children from entering swimming pools. There are two locations in the code that deal with swimming pools: The pool fence requirement that is triggered when pool water exceeds 18" and the building permit requirement that is triggered when pool water exceeds 24 The pool protection fence requirement has always been applicable to pools with water deeper greater than 18 However, we want to change the pool permit threshold requirement from 24" to 18" in order to be consistent with the 18" threshold that triggers the pool protection fence requirement. If we don't change the permit threshold for pools from 24" to 18" our inspectors will not be able to enforce the pool protection fence requirement for people building pools with water depth between 18" to 24 This amendment is necessary for consistency. 3. 15.03.030.010 202* Existing High Rise definition changed to 55 feet This amendment is not new and was previously enforced by the City of Anaheim and most other Orange County jurisdictions. This amendment is in response to a grand jury report, which recommends class A roofing in high fire hazard zones. Class A is the most fire retardant material available for this special area defined as all areas of the City of Anaheim east of the Costa Mesa Freeway (SR -55) and south of the Riverside Freeway (SR -91). This is an existing provision in the Anaheim Building Code. 13. 15.03.030.130 1613.7 New Minimum Distance for Building Separation The new code does not provide requirements for separation distances between adjacent buildings to allow for independent building displacement due to earthquake ground motions. This amendment specifies the minimum separation distance between adjoining buildings which are not structurally connected. This is a new amendment for Anaheim. 14. 15.03.030.140 1614 New Modifies calculation for suspended ceilings The new code lacked clear engineering guidelines for suspended ceilings. The Office of Statewide Health and Planning and Development recognized the void and adopted provisions for state buildings. We have recommended the same provisions for locally regulated buildings in Anaheim. This is a new amendment for Anaheim. 15. 15.03.030.180 3109.4.4 Existing Clarifies that pool fencing requirements apply to Private Pools This is an existing amendment addressing pool fencing to keep unsupervised children from entering swimming pools. This amendment clarifies that pool fencing /barriers apply to private swimming pools and provides a clearer definition as to what is a Private Pool. Code Amendments to be consistent with the Fire Code. Further information available in Exhibit B. EXHIBIT A 2007 California Building Electrical Codes Anaheim Local Amendments Summary Sheet December 11, 2007 Pa 2 of 3 16. 15.04.010 Article 310 Existing Requires continuous inspection for No. 6 aluminum wiring. This amendment is considered necessary due to the fact that improper installation creates a fire hazard and aluminum wire size #6 and smaller requires greater precision and care for installation. This is an existing provision in the Anaheim Building Code. This new amendment is being added to provide life saving equipment for immediate use by occupants of high rise buildings for patients in cardiac arrest because of the potential for increased 911 response times. This existing amendment is necessary in order to continue providing fire department access requirements consistent with the operational needs of the department and provide an adequate level of fire protection for the community. A, B, C, D 43 16.08.450 108 Appendix Chapter 1 Existing (1982) Establishes a Board of Appeals. This existing amendment is necessary in order to continue providing a method for determining the suitability of alternate materials and reasonable interpretations of the Fire Code by the Planning Commission when necessary. This amendment replaces a generic code section with one more suitable for the operation of the City of Anaheim. A, B, C, D, E 44 16.08.460 109.3 Appendix Chapter 1 Existing (1982) Establishes penalties. This existing amendment is necessary in order to continue providing a penalty clause for violations of the Anaheim Municipal Code. A, B, C, D, E 45 16.08.470 B105.1 of Appendix Chapter B Existing (2002) Requires minimum 1,500 gallons per minute from a fire hydrant. This existing amendment is necessary in order to continue providing fire hydrant minimum flow requirements consistent with the operational needs of the department and provide adequate level of fire protection for the community. This amendment raises the minimum fire hydrant flow from 1,250 GPM to 1,500 GPM. Summary with Justifications 12/7/2007 FINDINGS MATRIX 6 Item AMC Section IFC Code Section Amendment History Summary Findings 46 16.08.480 B105.2 of Appendix Chapter B Existing (2002) Allows 50% reduction in hydrant flow for a fire sprinklered building. This existing amendment is necessary in order to continue providing fire flow requirements consistent with the operational needs of the department and provide adequate level of fire protection for the community. This amendment reduces the maximum allowable reduction from 75% to 50% of fire flow for fully sprinklered buildings.
