A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING TWO PUBLIC UTILITY EASEMENTS
LOCATED AT 3110 EAST LA PALMA AVENUE PURSUANT
TO CALIFORNIA STREETS AND HIGHWAY CODE SECTION
8330, ET SEQ. SUMMARY VACATION. (Abandonment No.
ABA 2008 00169)
WHEREAS, an applicant has requested the vacation of two public utility easements
located at 3110 East La Palma Avenue, Anaheim California, in order to clear title to the land and
facilitate development of a new Carls' Jr. restaurant pursuant to Building Permit BLD2007- 02007;
and
WHEREAS, the public utility easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easements to be vacated are superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the two public utility easements, as set forth in an
easement deed recorded May 21, 1976, per book 11747, page 767 of Official Records, Orange
County, State of California and an easement deed recorded August 5, 1976, per book 11840, page
674 of Official Records, Orange County, State of California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 8th day of April 2008, by the following roll call vote:
AYES: Mayor Pringle, Council Members Hernandez, Sidhu, Galloway, Kring
