RESOLUTION 2011- 034
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING TWO PUBLIC UTILITY
EASEMENTS LOCATED AT 3811 EAST LA PALMA
AVENUE PURSUANT TO CALIFORNIA STREETS AND
HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABANDONMENT NO.
ABA20 1 1- 00220)
WHEREAS, an applicant has requested the vacation of two public utility easements
generally located at 3 811 East La Palma Avenue, in the City of Anaheim, County of Orange, State of
California, as more particularly described below, in order to clear title to the parcel of land in
conjunction with a future commercial development; and
WHEREAS, the public service easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easements to be vacated are superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the two public utility easements, as set forth as follows:
(i) a public utility easement generally located at 3 811 East La Palma Avenue in the City of Anaheim,
County of Orange, State of California, as set forth in an Easement Deed recorded April 1, 1912, in
Book 210, Page 242 of Official Records of the County of Orange and as more particularly described
in Exhibit "A" attached hereto and incorporated herein by this reference; and (ii) a public utility
easement generally located at 3811 East La Palma Avenue in the City of Anaheim, County of
Orange, State of California, as set forth in an Easement Deed recorded May 27, 1912, in Book 217,
Page 245 of Official Records of the County of Orange and as more particularly described in Exhibit
"A" attached hereto and incorporated herein by this reference.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
