RES-2011-045RESOLUTION NO. 2011- 045 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM RESCINDING PERMIT PARKING FOR WESTHAVEN DRIVE AND WESTHAVEN CIRCLE IN PERMIT - ELIGIBLE PARKING DISTRICT NO.5 ( "TWILA REID /STONYBROOK DISTRICT ") WHEREAS, Section 14.32.450 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code authorizes the City Council to, by resolution, designate any streets, or portions thereof, as "Permit Parking Only" streets; and WHEREAS, City Council Policy Number 5.7 (the "Council Policy ") sets forth a process to create a Permit - Eligible Parking District, and, following approval of the District, establishing a process enabling individual streets within the identified District boundary to request implementation of permit parking; and WHEREAS, the City Council previously adopted Resolution No.90R -389, restricting parking on certain city streets to permit parking only and thereby creating Permit- Eligible Parking District No. 5 ( "District No. 5 "); and WHEREAS, due to their proximity to Twila Reid Park, permit parking on Westhaven Drive and Westhaven Circle within District 5 is no longer necessary; and WHEREAS, Council Policy sets forth a process by which Permit Parking established on Streets may be rescinded; and WHEREAS, the steps recommended in the Council Policy have been duly followed to rescind Permit Parking on Westhaven Drive and Westhaven Circle in District No. 5, which areas are described and depicted in attached Exhibit "A" and incorporated herein by this reference; and WHEREAS, representatives of the community have met with the Neighborhood Services District Team and the Traffic and Transportation Manager, or his designee, to discuss removal of permit parking on Westhaven Drive and Westhaven Circle in District No. 5; and WHEREAS, a survey was sent to detennine if residents are in favor of rescinding pen parking on Westhaven Drive and Westhaven Circle in District No. 5, and a minimum 30% response rate among single family homes was achieved with a super majority of returned surveys in favor of removing pen parking from those streets in confonnance with the Council Policy; and WHEREAS, the City Council hereby finds and detennines that permit parking on Westhaven Drive and Westhaven Circle in District No. 5 is no longer necessary. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that vehicular parking on the following described streets shall no longer be restricted to permit parking: a. Westhaven Drive on both sides from Stonybrook Drive to Parkview Street. b. Westhaven Circle on both sides, from Westhaven Drive southerly to terminus of Westhaven Circle. Removing permit parking would allow anyone to park on those streets. Due to the proximity to Reid Park, some residents expressed the parking is no longer an issue on those streets. To remove permit parking, a two - thirds majority of voters on the street segment is required. A minimum of 30% of ballots must be returned.
