There should be no other issues for us to get building final and I believe the field team was calling for final inspection today. Thanks of your help. The intent of the non-buildable easement is to allow openings for a wall built on a true property line and for maintenance of building. It does not make sense to have equipment that can potentially be a hazard on another property other than the property/structure it serves. The field inspector is saying the location of the Garden House AC condensers are not permitted and is denying the building final. When we designed the community we had always planned for the condensers to be on this side of the home. The condensers lie within the 3’-1’ easement area for the adjacent lot home. The easements are recorded on each lot. We believe this condition meets the overall intent and spirit of the code and the easement. Can you please confirm that this is acceptable to allow our building final to complete? We are opening models. Attached are the Side Yard Easements that were recorded at the models. These recorded agreements provide for the location of the condensers in this location.
