RESOLUTION 2011- 047
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING A PUBLIC UTILITY
EASEMENT LOCATED AT 1500 NORTH MILLER
STREET, PURSUANT TO CALIFORNIA STREETS AND
HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABANDONMENT NO.
ABA2010- 00204)
WHEREAS, the City of Anaheim has entered into a lease agreement with the Orange
County Water District to lease property located at 3443 East Miraloma Avenue for the installation
and operation of a production water well, pipeline and appurtenant facilities, including egress from
and ingress to the well site; and
WHEREAS, as a condition of the lease agreement, the City of Anaheim is required to
abandon the easement set forth in an Easement Agreement between the City of Anaheim and Orange
County Water District recorded March 27, 1987 as Instrument Number 87- 166634 of Official
Records and more particularly described in Exhibits "A" and `B" attached hereto and incorporated
herein by reference; and
WHEREAS, the public service easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation ofpublic utilities
and there are no other public facilities located within the easement.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of a public utility easement, as set forth as follows: (i) a
public utility easement generally located at 1500 North Miller Street in the City of Anaheim, County
of Orange, State of California, as set forth in an Easement Agreement between the City of Anaheim
and Orange County Water District recorded March 27, 1987 as Instrument Number 87- 166634 of
Official Records and more particularly described in Exhibits "A" and "B" attached hereto and
incorporated herein by reference.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacatio n shall be
complete and the public service easements vacated shall no longer constitute publi
easements. c service
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 12th day of April
2011, by the following roll call vote:

feet in width, lying 5.00 feet on each side of the following described center line:

North 16 °51'25' Wiest, 140.43 feet; thence North 17 °58'11" Wiest 386.20 feet to a point in a line
that is parallel with and distant northeasterly 80.00 feet, measured at a right angle from the centerline
of Miller Street as shown on a map filed in Book 96, page 48 of Records of Surreys in the office of the
Recorder of said Orange County; thence along said parallel line North 16 °51'25" West 169.00 feet to
