RESOLUTION 2011- 060
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING EXCESS STREET RIGHT -
OF -WAY LOCATED ALONG THE WESTERLY SIDE OF
ANAHEIM BOULEVARD ADJACENT TO 425 SOUTH
ANAHEIM BOULEVARD PURSUANT TO
CALIFORNIA STREETS AND HIGHWAY CODE
SECTION 8330, ET SEQ. - SUMMARY VACATION.
(ABANDONMENT NO. ABA2011- 00224)
WHEREAS, the City of Anaheim currently owns an easement for road and public
utility purposes over a portion of land within Tentative Tract Map 17351 boundaries which exceeds
the required ultimate right of way along the westerly side of Anaheim Boulevard, adjacent to 425
South Anaheim Boulevard; and
WHEREAS, the applicant for Tentative Tract Map 17351 has requested the summary
vacation of this excess right -of -way in order to allow applicant to establish a six -lot subdivision for
the development of a 52 -unit condominium project; and
WHEREAS, the one and one -half foot wide strip of street right -of -way to be vacated
(1) exceeds the required ultimate right -of -way as per the Circulation Element of the City's General
Plan, (2) the area to be vacated is not required for present or prospective street use, (3) there are no
public utilities within the proposed vacation area and (4) the land to be vacated is considered excess
street right -of -way.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of that one and one -half foot wide strip of excess street
right -of -way located along the westerly side of Anaheim Boulevard adjacent to 425 South Anaheim
Boulevard in the City of Anaheim, County of Orange, State of California, more particularly
described in Exhibits "A" and `B" attached hereto and incorporated herein by reference.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed to, cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the excess right -of -way vacated shall no longer constitute a public service easement.
