2001-089RESOLUTION NO. 2001R-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO GRANT A NON-EXCLUSIVE FRANCHISE TO A WHITE AND YELLOW CAB DBA A TAXI CAB FOR THE PURPOSE OF OPERATING TAXICAB SERVICE IN THE CITY OF ANAHEIM; STATING THE TERMS AND CONDITIONS UPON WHICH IT IS PROPOSED TO GRANT THE FRANCHISE; AND ESTABLISHING THE DATE, HOUR AND PLACE WHEN AND WHERE ANY PERSONS HAVING ANY INTEREST THEREIN OR ANY OBJECTION THERETO MAY APPEAR AND BE HEARD THEREON. WHEREAS, the City of Anaheim has heretofore received an application for a non-exclusive franchise to operate taxicab service within the City of Anaheim from A White and Yellow Cab dba A Taxi Cab (the "Applicant"); and WHEREAS, the City Council of the City of Anaheim has reviewed said application, and has considered and weighed the information presented therein, and in the staff reports and reconm~endations and other relevant information relating thereto; and WHEREAS, Article XIV of the Charter of the City of Anaheim authorizes the City Council, by ordinance, to award franchises for transportation services pursuant to the procedures set forth therein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: SECTION 1. That the City Council hereby declares its intention to grant a non-exclusive franchise to A White and Yellow Cab dba A Taxi Cab for the operation of 50 taxicabs within the City of Anaheim and for temporary permits for the occasional or seasonal operation of up to 30 additional taxicabs at such times and upon such dates as specified in the Proposal. SECTION 2. That the terms and conditions upon which it is proposed to grant said franchise are each of those certain terms, conditions, limitations, representations and requirements as expressly set forth in (i) that certain Request For Proposals issued by the City on September 20, 2000 (the "RFP"); (ii) that certain Proposal submitted to the City by the Applicant dated as of October 25, 2000 (the ~Proposal"); and (iii) the regulations and requirements for the operation of taxicabs as set forth in the Anaheim Municipal Code as amended from time to time (the "Regulations"). The Proposal, the RFP and the Regulations are incorporated herein by this reference as if set forth in full. The aforesaid documents are on file, and available for public review or copying, in the Office of the City Clerk of the City of Anaheim during normal business hours. SECTION 3. Notice is hereby given that on Tuesday, June 12, 2001, at 6:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chamber of the Anaheim City Hall, 200 South Anaheim Boulevard, Anaheim, California, any persons having any interests in said proposed franchise, or any objection to the granting thereof, may appear before the City Council and be heard thereon. Notice is further given that the City Council will concurrently hear and consider other applications for taxicab franchises on such date and the total number of such applications the City Council will hear and consider exceeds the total number of franchises the City Council has heretofore determined to grant. Therefore, nothing contained in this resolution shall be considered as a commitment by the City Council to grant a franchise to this Applicant or any of the other franchise applicants. The City Council reserves the right to reject any or all applications at its sole and absolute discretion. SECTION 4. The City Clerk is hereby directed to publish this resolution at least once, within fifteen (15) days of the passage thereof, in the official newspaper of the City.
