RES-2011-077RESOLUTION NO. 2011- 077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM FIREFIGHTERS ASSOCIATION, LOCAL 2899 AND THE CITY OF ANAHEIM WHEREAS, the City of Anaheim and the Anaheim Firefighters Association, Local 2899, have met and conferred and reached an agreement concerning certain employees represented by the Anaheim Firefighters Association, Local 2899; and WHEREAS, the Anaheim Firefighters Association, Local 2899, is in agreement with the recommendation contained in said Letter of Understanding; and WHEREAS, as a result thereof, the Letter of Understanding dated May 24, 2011 between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated May 24, 2011 between the Firefighters Association, Local 2899, and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. TALLEY, CITY ATTORNEY BY: 0 '— C - ff le�� LETTER OF UNDERSTANDING between the ANAHEIM FIREFIGHTERS ASSOCIATION, Local 2899 and the CITY OF ANAHEIM WHEREAS, the Anaheim Firefighters Association, Local 2899 ("AFA' received formal notification from the City of Anaheim ("ANAHEIM'S of ANAHEIM's intent to eliminate one (1) Fire Company consisting of three (3) Fire Captains, three (3) Fire Engineers, and six (6) Firefighters effective June 14, 2011, which could result in eight employees represented by AFA being laid off, in order to reduce ANAHEIM's general fund expenditures. WHEREAS, ANAHEIM and AFA have reached an agreement to avoid those layoffs while still accomplishing the reduction in general fund expenditures sought to be achieved by ANAHEIM. WHEREFORE, the parties agree as follows: 1. ANAHEIM shall not layoff those individuals who are not otherwise assigned to specific fire suppression positions based upon their departmental seniority, but shall instead retain those employees as relief suppression firefighters, who shall be assigned to fill vacant positions resulting from planned or unplanned absences of other suppression employees or, if there are no available vacant positions, as additional personnel on fire suppression apparatuses. 2. The employees identified above in paragraph 1. shall be reassigned to established fire suppression positions as those positions become vacant through resignation or retirement. Such reassignment shall be made on the basis of department seniority. This Agreement constitutes the entire agreement between the parties, shall not be construed as establishing precedent, and shall not prejudice either party in any future discussions, negotiations, or grievances on any issue.
