A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ADOPTING CERTAIN FEES TO COVER THE
COST OF ADMINISTRATION OF CHAPTER 4.29 OF
TITLE 4 OF THE ANAHEIM MUNICIPAL CODE
REGULATING MASSAGE ESTABLISHMENTS
WHEREAS, the City of Anaheim is authorized, by virtue
of the State Constitution, the provisions of the City Charter and
Sections 51030 and 51031 of the Government Code, to regulate
massage establishments by imposing reasonable standards relative
to the skill and experience of massage operators and massage
technicians and reasonable conditions on the operation of the
massage establishment; and
WHEREAS, the City has adopted Ordinance No.527j
repealing Chapter 4.29 in its entirety and adopting a new Chapter
4.29 to Title 4 of the Anaheim Municipal Code regulating massage
establishments in the City, which authorizes certain fees to
cover the City's cost of administration of Chapter 4.29 to be
established by resolution of the City Council;
WHEREAS, Ordinance No.577] further authorizes the
City Council to include in the resolution a Health Services Fee
Schedule prescribing the fees to be paid by the operator of each
massage establishment directly to the County of Orange Health
Department for services rendered by said Department related to
Chapter 4.29;
WHEREAS, the City Council desires to establish a
schedule of fees in connection with Chapter 4.29 of Title 4 of
the Anaheim Municipal Code relating to regulation of massage
establishments;
WHEREAS, the City Council of the City of Anaheim has
established a policy to adopt all fees and charges to be
collected within the City of Anaheim by resolution; and
WHEREAS, the fees and charges set forth herein do not
exceed the actual cost to the City of providing the services to
which the fees and charges relate; and
WHEREAS, the City Council further finds and determines
that the establishment of fees is exempt from the provisions of
the California Environmental Quality Act pursuant to Section
21080 (b)(8) o£ the California Public Resources Code; and
WHEREAS, the City of Anahelm has complied with the
applicable notice and hearing requ±rements pertaining to adopting
fees as set forth in the Government Code of the State of
California.
NOW, THEREFORE, BE IT RESOLVED by the City Council
the City of Anaheim that the following fees for the
administration of Chapter 4.29 be, and the same are hereby,
adopted:

BE IT FURTHER RESOLVED by the City Council of the City
of Anaheim that the following Health Services Fees will be levied
by the City of Anaheim, and shall be paid directly to the County
of Orange:
Massage Establishment Inspection Fees: $130.00,
annually, or such other fees or rates adopted by the Orange
County Board of Supervisors in effect at the time such inspection
services are rendered.
BE IT FURTHER RESOLVED by the City Council that this
Resolution supercedes Resolution No. 77R-302 or the provisions of
any other prior resolution to the extent that such provisions
conflict with the provisions of this Resolution.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 5th day of June ,
2001.
