RES-2011-128 RESOLUTION NO. 2011- 128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CITY OF ANAHEIM'S CHIEF OF POLICE OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION ON BEHALF OF THE CITY OF ANAHEIM, WITH THE STATE OF CALIFORNIA, OFFICE OF TRAFFIC SAFETY (OTS), FOR THE SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP), AND AUTHORIZING THE CITY OF ANAHEIM'S CHIEF OF POLICE OR HIS DESIGNEE TO TAKE SUCH OTHER ACTIONS IN FURTHERANCE OF THE GRANT AS ARE NECESSARY AND TO EXECUTE ALL REQUIRED GRANT DOCUMENTS, AND, IF AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY AND AMENDING THE BUDGET FOR FISCAL YEAR 2011 -12 ACCORDINGLY. WHEREAS, The State of California, Office of Traffic Safety (the "Grantor ") has heretofore invited public agencies, including the City of Anaheim, a municipal corporation and charter city ( "City "), to submit applications for the Selective Traffic Enforcement Program (STEP) Grant (the "Grant "); and WHEREAS, the City desires to submit an application to Grantor for said Grant; and WHEREAS, the City is familiar with the terms, conditions and limitations of any such Grant; and WHEREAS, the City is willing and able to conform to each of the terms, conditions and limitations imposed upon any such Grant to the City; and WHEREAS, the City desires to accept any such Grant which may be awarded to the City; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations and expenditures in the appropriate City program to reflect such award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Anaheim Chief of Police or his designee is hereby authorized to submit a grant application for and on behalf of the City, a public entity established under the laws of the State of California, for the Grant. 85313 2. The City Council of the City hereby agrees to, and by this Resolution, does accept any such Grant so awarded to the City without further action of the City Council being required therefor. 3. The Anaheim Chief of Police or his designee is hereby authorized and directed to take any necessary actions and to execute any agreements, certificates and /or assurances, reports, plans, payment requests, or other documents, including by not limited to a Grant Agreement, as may be necessary for the purpose of obtaining assistance provided by the Grantor, including any extensions and amendments thereof. 4. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the Anaheim Chief of Police or his designee is hereby authorized and directed to take any necessary actions and to execute any agreements, assurances, or other documents as may be necessary in connection with the acceptance and implementation of said Grant as may be required by the Grantor, if such Grant is awarded to the City. 5. The annual budget of the City of Anaheim for Fiscal Year 2011 -12 shall be amended by increasing the appropriations and authorized expenditures in Program No. 218 - 309 -3032 in such amounts as are equal to the amount of Grant funds to be received by the City.
