PROJECT INFORMATION Lorena’s Banquet is seeking approval from the City of Anaheim for its proposed 5,940-sq.ft. banquet and reception business at 2660 W. La Palma Ave. The banquet facility will host events on weekends only(Friday, Saturday and Sunday) between 4:00 P.M. and 11:00 P.M. on Friday through Sunday. EXISTING CONDITIONS The proposed facility situates in a commercial building at 2654 to 2660 W. La Palma Ave in the City of Anaheim. The subject unit is currently vacant and there are two existing tenants in the building: Lens Crafter and Friends Medical Clinic, as shown in Appendix A. Parking spaces are shared by all tenants and their customers. This study has counted for a capacity of 124 parking spaces, as shown in Exhibit 1. The requirements are as follows: 0.333 space per fixed seat, or 29 spaces per 1,000 square feet of GFA, whichever results in a greater number of spaces, plus 4 spaces per 1,000 square feet of GFA for office use, plus, if a kitchen facility is provided, 0.02 space per person for the maximum capacity figure of the assembly area determined by the City Fire Department; if other types of ancillary uses other than a Sunday school are included, a parking demand study may be required. La Palma Ave. Parked vehicles were counted at the parking lot every 30 minutes between 4:00 P.M. and 8:00 P.M. on Friday, December 18, 2010 and Saturday December 19, 2010. Our observation found that more parking spaces are available on Saturday as one of the existing tenants, Friends Medical Clinic, is closed by noon. Actual parking reached its peak on Friday at 5:00 P.M. when 35 parking spaces were occupied. Parking usage decreased consistently after 5:00 P.M. Complete survey data can be found in Appendix C. WHEREAS, the proposed project falls within the definition of Categorical Exemptions, Section 15311, Class 11(Accessory Structures)as defined in the State CEQA Guidelines, and is therefore, exempt from the requirement to prepare additional environmental documentation. PC2011-*** A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION DETERMINING THAT A CLASS 1 CATEGORICAL EXEMPTION IS THE APPROPRIATE ENVIRONMENTAL DETERMINATION ANDAPPROVING VARIANCE NO. 2011-04863, IN PART, (DEV2011-00090) (888 SOUTH DISNEYLAND DRIVE) WHEREAS, the Anaheim Planning Commissiondid receive a verified Petition for Variance for certain real property situated in the City of Anaheim, County of Orange, State of California shown on Exhibit “A”, attached hereto andincorporatedherein by this reference; and WHEREAS, the petitioner requestsa variancefor wall signage for an existing bank located within an office building with asign copy that has a logoand sign arealarger than permitted by codeand a logo located closer than one-half the size of the largest letter/symbol to the top and sides of the building wall;and WHEREAS, the Planning Commissiondid hold a public hearing at the Civic Center in the City of Anaheim onNovember 7,at 5:00p.m.,notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 “Procedures”, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1.That the applicant requests to deviate fromthe following topermit two wall signs: SECTION NO. 18.116.160.050Wall Sign Requirement(maximum logo height 48inchespermitted;60 inches proposed; maximum sign area 160squarefeet per wall sign permitted; 209square feet per sign proposed; minimum distance required between proposed logo and top of the building wall 30inches requiredfor a 60-inch logo;9inches proposed) 2.The requested variancerelated to the maximum permitted wall sign area is hereby approvedbecause there are exceptional circumstances related to the property given its location on the periphery of the Anaheim Resort and given its non- conforming use as a multi-tenant office building. -1-PC2011-*** 3.The requested variancerelated to the proposed 60-inch high logos and their placement 9-inches from the top of the building is hereby denied based upon the fact that the granting of this variance would result in sign which appears to be disproportional in size in comparison to the sign bandto which it would be attached. Reducing the logo to the maximum permitted 48-inches would result in a sign that is proportional to its mounting surface and would allow the sign to be located at least 24-inches from the top of the building perCode requirements. In addition, the applicant has not provided adequate justification to allow a larger logo than permitted. WHEREAS, the proposed project falls within the definition of Categorical Exemptions, Section 15301,Categorical Exemptions,Section 15301, Class 11 (Accessory Structures)and is therefore, exempt from the requirement to prepare additional environmental documentation. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission for the reasons hereinabove stated does hereby grantdoes hereby grant Variance No. 2011-04863,in part, to permit two wall signs larger than permitted by Code on the north and south building elevations and denying the variance request related to the size and location of the proposed logo signs, subject tothe conditions of approval herein. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Anaheim Municipal Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition (s), (ii) the modification complies with the Anaheim Municipal Code and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. The property is located in the I(Industrial)zone and the Anaheim General Plan designates the property for Industrialland uses; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 7, 2011, at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed tentative parcel map and conditional use permit to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearingwith respect to the requestto permit automobile sales and an outdoor storage yard in conjunction with an existing adult rehabilitation facility with fewer parking spaces than required by Codeshould be approved for the following reasons: 1.The proposed request to permit automobile sales and an outdoor storage yard in conjunction with an existing adult rehabilitation facility in theIndustrial(I) zone is properly one for which a conditionaluse permit is authorized by Anaheim Municipal Code Section 18.10.030.010 (Automotive–Car Sales & Rental,Outdoor Storage Yards). 2.The proposed the conditional use permit to permit automobile sales and an outdoor storage yard in conjunction with an existing adult rehabilitation facility, as conditioned herein, would not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located because the building is surrounded by andintegrated with similar buildingsand uses. -1-PC2011-*** 3.The size and shape of the site for the use is adequate to allow the full development of the proposed automobile sales and an outdoor storage yard in conjunction with an existing adult rehabilitation facility in a manner not detrimental to the particular area or to the health and safety because theproposed automobile sales will be located within an existingindustrial building and the outdoor storage yard is surrounded by railroad right-of-way and compatible industrialuses. 4.The traffic generated by the proposed automobile sales and outdoor storage yard in conjunction with an existing adult rehabilitation facility will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because the traffic generated by theseusesis consistent with the uses designated for this area. 5.The granting of the conditional use permit and the variance under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim as the proposed automobile sales andoutdoor storage yardwill be compatible with the surrounding area because the use is integrated with other uses on the property and is not a health or safety risk to the citizens of the City of Anaheim. WHEREAS, the Planning Commission does further find and determine that the request for a variance to permit less parking than required by Code for automobile sales and an outdoor storage yard in conjunction with an existing adult rehabilitation facilityshould be approved for the following reasons: SECTION NO. 18.42.040.010Minimum number of parking spaces. (289 spaces required;139spaces proposed). 1.The requested variance is hereby approvedbased upon the findings and conclusions contained in a parking demand study prepared by LinscottLaw and Greenspandated March 31, 2011,and based upon the findings in the parking study also prepared by Linscott Law and Greenspan dated December 12, 1997 for Conditional Use Permit No. 3991used to determine the number of parking spaces necessary for the addition of the women’s rehabilitation facility. The 2011 parking study concludes that the existing number of parking spaces was sufficient as 68spaces would be needed forthe rehabilitation facility and automobile sales, with 139spaces providedon the property. 2.The variance will not increase the demand and competition for parking spaces upon the public streets in the immediate vicinity of the proposed use because sufficient parking is provided onsite. 3.The variance will not increase the demand andcompetition for parking spaces upon adjacent private property in the immediate vicinity of the proposed use because sufficient parking is provided. -2-PC2011-*** 4.The variance will not increase traffic congestion within the off-street parking areas or lots provided forthe proposed use because all parking will be contained on the subject property. 5.The variance will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the proposed use because the project does not propose new ingress or egress points and is designed to allow adequate on-site circulation. WHEREAS, the proposed project falls within the definition of Categorical Exemptions, Section 15301, Class 1 (Existing Facilities)as defined in the State CEQA Guidelines, and is therefore, exempt from the requirement to prepare additional environmental documentation.
