RES-2012-033 RESOLUTION NO. 2012-033 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO GRANT NON- EXCLUSIVE TAXICAB FRANCHISES FOR THE PURPOSE OF OPERATING TAXICAB SERVICE IN THE CITY OF ANAHEIM; STATING THE TERMS AND CONDITIONS UPON WHICH IT IS PROPOSED TO GRANT THE FRANCHISES; AND ESTABLISHING THE DATE, HOUR AND PLACE WHEN AND WHERE ANY PERSONS HAVING ANY INTEREST THEREIN OR ANY OBJECTION THERETO MAY APPEAR AND BE HEARD THEREON WHEREAS, the City of Anaheim has heretofore received applications for a non- exclusive franchise to operate taxicab service within the City of Anaheim from Yellow Cab of Greater Orange County, Inc. dba Yellow Cab Co.; Cabco Yellow Inc. dba California Yellow Cab; A White and Yellow Cab Inc. dba A Taxi Cab; and American Ground Transportation, Inc. dba 24/7 Taxi Cab (hereinafter the "applicants "); and WHEREAS said applications have been presented to the City in the form of proposals for providing taxicab service by Yellow Cab of Greater Orange County, Inc. dba Yellow Cab Co.; Cabco Inc. dba California Yellow Cab; A White and Yellow Cab Inc. dba A- Taxi Cab; and American Ground Transportation, Inc. dba 24/7 Taxi Cab and dated March 28, 2012 (hereinafter the "Proposals ") which Proposals were submitted in response to a request for proposals issued by the City on March 5, 2012 (hereinafter the "RFP "); WHEREAS, said RFP and the Proposals are on file in the office of the City Clerk of the City of Anaheim and which are incorporated herein by this reference as if set forth in full and are hereinafter collectively referred to as the "Applications;" WHEREAS, the City Council of the City of Anaheim will review said Applications, and will consider and weigh the information presented therein and the staff report and recommendations and other relevant information relating thereto as presented or made available to the City Council at its regular City Council meeting to be held on May 8, 2012; and WHEREAS, Article XIV of the Charter of the City of Anaheim authorizes the City Council to award franchises for transportation services, by ordinance, pursuant to the procedures set forth therein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: SECTION 1. That the City Council hereby declares its intention to grant non - exclusive franchises for the operation of Two Hundred and Fifty Five (255) taxicabs within the City of Anaheim as specified in the Applications on file herein. SECTION 2. That the terms and conditions upon which it is proposed to grant said franchises are each of those certain terms, conditions, limitations and representations as expressly set forth in the Applications on file herein. SECTION 3. Notice is hereby given that on Tuesday May 8, 2012, at 5:30 p.m., or as soon thereafter as the matter may be heard, in the City Council Chamber of the Anaheim City Hall, 200 South Anaheim Boulevard, Anaheim, California, any persons having any interests in said proposed franchises, or any objection to the granting thereof, may appear before the City Council and be heard thereon. SECTION 4. The City Clerk is hereby directed to publish this resolution at least once, within fifteen days of the passage thereof, in the official newspaper.
