RESOLUTION 2012- 038
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING TWO PUBLIC UTILITY
EASEMENTS LOCATED AT 2738 WEST LINCOLN
AVENUE PURSUANT TO CALIFORNIA STREETS AND
HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABANDONMENT NO.
ABA2012- 00248)
WHEREAS, the City of Anaheim has received a request from the Anaheim Housing
Authority for the vacation of two existing public utility easements upon property located at 2738
West Lincoln Avenue, in order to clear title to the land to allow for the development of a forty -two
(42) unit affordable multi - family rental project; and
WHEREAS, the public service easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easements to be vacated are superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the two public utility easements as set forth in an
Easement Deed recorded August 3, 1969 in Book 9046, Page 245 of Official Records and an
Easement Deed recorded August 8, 1969 in Book 9046, Page 247 of Official Records of the County
of Orange, California.
BE IT FURTHER RESOLVED that the vacations authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacations shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
