97-069RESOLUTION NO. 97R -69 A RESOLUTION OF THE COUNCIL OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DESIGNATING UNDERGROUND DISTRICT NO. 29 (WALNUT STREET) WHEREAS, a public hearing was held by the City Council of the City of Anaheim on May 20, 1997 at the hour of 6:00 P.M., to ascertain whether the public necessity, health, safety or welfare requires the removal of Overhead Facilities of Utilities, as these terms are defined in Section 17.24.010.060 and 17.24.090, respectively, of the Anaheim Municipal Code, and the Underground installation of such Overhead Facilities, including the property owner's service laterals, in accordance with the provisions of Chapter 17.24 of the Anaheim Municipal Code; and WHEREAS, notice of the time and place of such hearing was provided by the City Clerk by mail to all affected property owners as shown on the last equalized assessment roll and to all utility companies concerned at least ten days prior to the date of the hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS: 1. The City Council hereby finds and determines that the public health, safety and welfare as well as each of the specific public purposes enumerated in Section 17.24.020 of the Anaheim Municipal Code, require the removal of the Overhead facilities of Utilities, as these terms are defined in Section 17.24.010.060 and 17.24.090, respectively, of the Anaheim Municipal Code, and the Underground installation of such Overhead facilities, including the property owners' service laterals, in accordance with the provisions of Chapter 17.24 of the Anaheim Municipal Code. 2. Pursuant to Section 17.24.040 of the Anaheim Municipal Code, the City Council hereby declares the above described area to be an underground utility district, as this term is defined in Section 17.24.010.080 of the Anaheim Municipal Code, to be known as Underground District No. 29 (WALNUT AVENUE) (District No. 29). 3. The City Council does hereby fix October 30,1997 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of Overhead Facilities of Utilities, as these terms are defined in Section 7.29.010.060 and 17.29.090, respectively, of the Anaheim Municipal Code, and the Underground installation of such Overhead Facilities, including the property owners' service laterals, in accordance with provisions of Chapter 17.29 of the Anaheim Municipal Code, on or before December 31, 1997. 4. The City Council hereby determines that this Resolution shall apply to the Overhead Facilities of Utilities, including the property owners' service laterals, 12,000 volt circuits and associated facilities, street light circuits, communications lines, telecommunications facilities, telephone lines and associated facilities, telegraph, cable television, installation of street lights, and the installation of substructures, conduits, and cable lines in the public right -of -way. 5. The City Council hereby finds and declares that designation of District No. 29 is consistent with the Infrastructure and Parking Finance Agreement for the Disney Resort, The Anaheim Resort and the Convention Center Expansion adopted by the Anaheim Public Finance Authority on October 8, 1996. 6. The City Council hereby finds and declares that designation of District No. 29 will avoid or eliminate an unusually heavy concentration of overhead electric facilities, that said street or road right -of -way is extensively used by the general public and carries a heavy volume of pedestrian or vehicular traffic and will remove obstructions and will improve safety by removing obstructions to pedestrian and vehicular visibility. 7. The City Council hereby requests that all Utilities with Overhead Facilities within District No. 29 underground their Overhead Facilities, including the property owners' service laterals, in accordance with the provisions of Chapter 17.29 of the Anaheim Municipal Code. 8. The City Clerk is hereby directed to notify all affected utilities and all persons owning real property within District No. 29 as provided in Section 17.29.090 of the Anaheim Municipal Code. Johnson Director of Public Works and City Engineer /Superintendent of Streets SUBJECT: UNDERGROUND DISTRICT NO. 29 WALNUT STREET FROM BALL ROAD TO KATELLA AVENUE Underground District No. 29 involves Walnut Street from Ball Road to Katelia Avenue. Walnut Street is designated as a Secondary Arterial Highway and is intended to collect and distribute traffic between local streets, major and primary arterial highways. Traffic safety is a major concern throughout this planned underground district. This district includes the Walnut Street/Ball Road intersection, which ranks as the 26th highest accident location in the recent 12 -month Citywide accident count. Also in this district is the Katelia Avenue/Walnut Street intersection, which ranks 30th highest in the recent 12 -month Citywide accident count. Twenty-seven total collisions occurred along this segment of Walnut Street during the same 12 -month period. Of the total, 12 were rear -end, eight were broadside, four were side swipe, one was single- vehicle -hit- fixed object, one was head -on and one was other type. In many of these incidents, sight distances impaired by utility poles may be a collision factor. I therefore recommend that, pursuant to Chapter 17.24 of the City of Anaheim Municipal Code, the City of Anaheim adopt a resolution creating Underground District No. 29 which includes the high accident locations of Walnut Street/Ball Road and Walnut Street/Katella Avenue. The purpose of the undergrounding projects is set forth in Section 17.24.020 of Chapter 17.24 and includes traffic safety. Overhead electric facilities contribute to the obstruction of visibility of pedestrian and vehicular traffic at both intersections and driveways. Under certain circumstances, such overhead facilities may obstruct the vision of pedestrians and vehicle drivers, and adversely impact public use of the intersections and street segments. For these reasons, I strongly recommend the removal and/or relocation of all utility facilities within the Walnut Street segments and that such work be performed concurrently with the City's underground project.
