PC 67-143APC67-143 -A RESOLUTION NO. A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAFIEIM THAT PETITION FOR CONDITIONnT. USE PERMIT 949 $E GRANTED WHEREAS, the City Planning Commission of the City of Meheim did receive a verified Petition for Conditional Use Permitfrom ANAHEIM TRANSPORTATION CENTER, 1571 West Katella Avenue, Suite C, Anaheim, California, Owner; RAI~ERG AND LOWREY, 2127 North Main Street, Santa Ana, California, Agent of certain real property situated in the City of Anaheim, County of Orange, State of Californi~ described in Exhibit "A" attached hereto and referred to herein as though set forth ; and WHEREAS, the City Plenning Commission did hold a public hearing et the City Hall in the City oE Anaheim on July 6, 1967y at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required by law and in accordance with the provisions of the Meheim Municipal code, Chepter 18.64, ta hear and consider evidence for and against said proposed conditional use and to investigate and meke findings and recommendetions in connection therewith; and WHEREAS, said Commission, efter due inspection, investigation, end study made by itself and in its behalf, end after due consideration of all evidence and teports offered at seid hearing, does find and determine the following facts: 1. That the proposed use is properly one for which e Conditional .Use Permit is euthorized by this Code, to wih Section 18.64.020(5), estaolish a transportation center with related offices, in conjunction with a proposed restaurant with on-sale liquor. 2. That the proposed use will nat edversely affect the adjoining land uses and the growth end development of the area in which it is proposed to be loceted. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimentel to the particular erea nor to the peace, health, sefety, and general welfare oE the Citizens of the City of Maheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, sefety, and generel welfere of the Citizens of the City of Anaheim. 5. That approval of this petition in no way commits the City o: Anaheim to provide continuing access easements to or across the Cunvention Center from subject property, since the development plans indicate that the proposed facility is caoable of beina operated as a self-contained project. 6. That no one apoeared in opposition to subject petition. That the lessees of subiect property shall pay to the City of Anaheim the sum of 15~ per front foot along Katella Avenue, for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 4. That any air-conditioni.ng facilities shall 6e properly shielded from view. 5. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to the time w~ ihat the Bu~lding Permit is issued, or within a period of 180 days from date hereof, whichever occurs first, or such further time as the Commi=sion or City Council may grant. 6. That Condition Nos. 3 and 4, above mentioned, shall be romplied with prior to final building and zoning inspections. 7. That subject property shall be developed substantially in accordance with plans ar,d specifications on file with the City of Anaheim, marked Exhibit IJo. 1, Revision fJo. 1, and Exhibit Nos~ 2, 3, 4, 5, and 6; provided that the proposed bus depot sha11 be a totally independent facility, self-contained, and in no way dependent upon continuing access easements _ across the Convention Center property.
