2001-214RESOLUTION NO. 2001R-214 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING CERTAIN EASEMENTS FOR PUBLIC UTILITY PURPOSES LOCATED GENERALLY ON THE NORTH SIDE OF LINCOLN AVENUE, EAST OF BEACH BOULEVARD (Abandonment No. 96-6A) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 7th day of August, 2001, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of those certain easements for public utility purposes, more particularly described as follows: See Exhibit A attached hereto; provided, however, that this action shall serve only to terminate the rights of the public to use said street, highway, or public service easement and shall not be construed to convey or relinquish any property interest of the City of Anaheim in and to said street, highway or public service easement. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange. MAO/R/~O~FT~HEiM 34144.31 EXHIBIT "A" Those certain Easements and Facilities in the City of Anaheim, County of Orange, State of California, which are located within the boundaries of Lots 2 through 17 of Tract No. 11830, recorded May 23, 1985 in Book 540, Pages 14, 15, 16, and 17 of Miscellaneous Maps described as follows: That certain 28-foot-wide easement for public utility purposes and ingress and egress rights for public utility maintenance purposes as dedicated to The City of Anaheim per said Tract Map. That certain 5-foot-wide easement for public utility purposes as dedicated to The City of Anaheim per said Tract Map. The public street lighting system and appurtenances as dedicated to The City of Anaheim per said Tract Map. The domestic water system and appurtenances as dedicated to The City of Anaheim per said Tract Map. That certain 6-foot-wide easement for poles and conduits per instrument recorded in Book 3620, Page 583, Official Records of Orange County. Those certain 6-foot-wide and 1 O-foot wide easements for pole lines and conduits, and for underground lines, per instrument recorded in Book 7397, Pages 728 and 729, Official Records of Orange County.
