RESOLUTION 2013- 013
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING AN EASEMENT FOR ROAD
AND PUBLIC UTILITY PURPOSES LOCATED AT THE
FORMER INTERSECTION OF ATCHISON STREET
AND WATER STREET, PURSUANT TO CALIFORNIA
STREETS AND HIGHWAY CODE SECTION 8330, ET
SEQ. - SUMMARY VACATION. (ABANDONMENT NO.
ABA2013- 00253)
WHEREAS, the City of Anaheim has received a request from the Anaheim Housing
Authority and Brookfiled Homes for the vacation of an easement for road and public utility purposes
over a portion of land within the boundaries of Tentative Tract Map No. 17422, Anaheim, CA, in
order to clear title to the land to allow for the development of Phase Four of Colony Park
development; and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities;
and
WHEREAS, there are no public utilities in place which would be affected by the
vacation; and
WHEREAS, the easement is not required for present or prospective public road or
public utility purposes; and
WHEREAS, the easement to be vacated is considered excess street right -of -way.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of an easement for road and public utility purposes, as set
forth in Instrument No. 87- 274636 recorded on May 15, 1987, in Official Records of Orange County,
California.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
