Resolution-PC 2013-012RESOLUTION NO. PC2013 -012 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION APPROVING RECLASSIFICATION NO. 2012-00251 AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH. (DEV2012- 00143) (1256, 1266, 1272 AND 1280 -90 EAST LINCOLN AVENUE AND 113,115 AND 117 FAHRION PLACE) WHEREAS, the Planning Commission of the City of Anaheim (herein referred to as the 'Planning Commission ") did receive a verified Petition for reclassification, designated as Reclassification No. 2012- 00251, for that certain real property located at 1256, 1266, 1272, 1280 -90 East Lincoln Avenue and 113, 115 and 117 Fahrion Place, in the City of Anaheim, County of Orange, State of California, as generally depicted on the map attached hereto as Exhibit A and incorporated herein by this reference (herein referred to as the 'Property "); and WHEREAS, the Property consists of commercial, residential and vacant properties located in the C -G (General Commercial) Zone and RM -3 (Multiple - Family Residential) Zone. The Anaheim General Plan designates the Property for Medium Density Residential land uses; and WHEREAS, the applicant requests to rezone the Property from the C -G (General Commercial) zone and RM -3 (Multiple- Family Residential) Zone to the RM -4 (Multiple- Family Residential) Zone; and WHEREAS, on January 28, 2013, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Anaheim Municipal Code (herein referred to as the "Code "), to hear and consider evidence for and against said proposed Reclassification No. 2012 -00251 and to investigate and make findings and recommendations in connection therewith; and WHEREAS, as the "lead agency' under the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA "), the Planning Commission finds and determines that Environmental Impact Report No. 330 (EIR 330), certified in conjunction with the City's General Plan Update program, is all that is necessary in connection with the proposed reclassification of the Property and its approval and that none of the conditions set forth in Sections 15162 or 15163 State CEQA of the Guidelines calling for the preparation of a subsequent environmental impact report or a supplement to EIR 330 have occurred; and WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: - 1 - PC2013 -012 1. Reclassification of the Property from the C -G (General Commercial) zone and RM -3 (Multiple - Family Residential) Zone to the RM -4 (Multiple- Family Residential) Zone is consistent with the property's existing Medium Density Residential General Plan land use designation; and 2. The proposed reclassification of the Property is necessary and /or desirable for the orderly and proper development of the community and is compatible with surrounding land uses to the north east, west and south which are designated for Medium Density Residential, Low - Density Residential and School land uses. Moreover, the proposed reclassification is compatible with the surrounding properties which are developed with apartments to the north across Lincoln Avenue and to the south; and 3. The proposed reclassification of the Property does properly relate to the zone and its permitted uses locally established in close proximity to the property and to the zones and their permitted uses generally established throughout the community. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does hereby unconditionally approve Reclassification No. 2012 -00251 to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to rezone and reclassify the property into the RM -4 (Multiple- Family Residential) Zone. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the Property; any such rezoning shall require the adoption of an ordinance by the City Council, which shall be a legislative act, and may be approved or denied by the City Council in its sole discretion.
