A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING RESOLUTION NO. 2001R-00164, NUNC
PRO TUNC, RELATING TO ZONING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT:
WHEREAS, the City Council of the City of Anaheim did, on
June 19, 2001, adopt Resolution No. 2001R-164; and
WHEREAS, through inadvertence and clerical error, an
incomplete legal description of the property was stated in said
resolution; and
WHEREAS, the City desires, and the public interest and
general welfare requires, that said error be corrected nunc pro tunc.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that Resolution No. 2001R-164 be, and the same is
hereby amended, nunc pro tunc, by amending the legal description of
that certain property situated in the City of Anaheim, County of
Orange, to read as follows:
Parcel A:
That portion of the lands allotted to Paula
Peratta De Dominguez, as described in the Final
Decree of Partition of the Rancho Santiago de
Santa Ana, which was entered September 12, 1868 in
Book "B", page 410 of Judgments of the District
Court of the 17th Judicial District in and for Los
Angeles County, California, bounded as follows:
on the North by the Southerly boundary lines of
Tract No. 10407 and Tract No. 10409, as said
Tracts are shown on Maps recorded, respectively,
in Book 486, pages 14 to 16 and in Book 529, pages
5 through 8 both of Miscellaneous Maps, records of
said Orange County;
on the Southwest and West by Tract by the
Northeasterly and~ Easterly boundary of Tract No.
14855, as shown on Map recorded in Book 719, pages
28 through 30 of Miscellaneous Maps, records of
Orange County, California;
on the South by the general Northerly line of
Imperial Highway, 106.00 feet in width, as
described in that certain Easement Deed recorded
March 6, 1995 as Instrument No. 95-0091497 of
Official Records of Orange County, California.
Parcel B:
That portion of Imperial Highway included within
Tract No. 10409, as shown on a Map recorded in
Book 529, pages 5 through 9
inclusive of Miscellaneous Maps, records of Orange
County, California.
Excepting therefrom all minerals, oil, gas,
petroleum and other hydrocarbon substances and all
underground water in, under or which may be
produced from said land, without, however, the
right to enter upon the surface of said land or
the subsurface thereof at any point above a depth
of 500 feet from the surface thereof, measured
vertically from the surface thereof, as reserved
in the Deed from Texaco Anaheim Hills, Inc., a
Delaware Corporation, recorded March 30, 1984 as
Instrument No. 84-132985 of Official Records.
Parcel C:
That portion of Imperial Highway included within
Tract No. 10407, as shown on a Map recorded in
Book 486, pages 14, 15 and 16 of Miscellaneous
Maps, records of Orange County, California.
Excepting therefrom that portion lying
Southeasterly of the Northwesterly line of
Imperial Highway 106.00 feet in width, as
described in that certain Easement Deed recorded
March 6, 1995 as Instrument No. 95-0091497 of
Official Records of Orange County, California.
Also, excepting therefrom that portion lying
Easterly of the Southerly prolongation of the East
line of Lot 14 of said Tract No. 10407.
Also excepting all oil, gas, hydrocarbon and other
minerals lying below a depth of 500 feet from the
surface of said lands but excluding any surface
rights in connection therewith, and also excepting
and reserving unto grantor the right to drill into
and through said land below a depth of 500 feet
from the surface, as reserved in Deed from Texaco
Anaheim Hills, Inc., a Corporation, recorded March
28, 1980 in Book 13554, page 1479 of Official
Records.
BE IT FURTHER RESOLVED that in all other respects, said
Resolution No. 2001R-164 shall remain in full force and effect.

THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim this 6th day of November , 2001.
