RES-2013-043 RESOLUTION NO. 2013- 043 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING PERMIT- ELIGIBLE PARKING DISTRICT NO. 23 ( "WALNUT CANYON RESERVOIR ") AND DESIGNATING FLICKER COURT AND THRASHER WAY NORTH OF LAKETOP DRIVE AS "PERMIT PARKING ONLY" STREETS. WHEREAS, Section 14.32.450 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code authorizes the City Council to, by resolution, designate any streets, or portions thereof, as "Permit Parking Only" streets; and WHEREAS, on August 7, 2007 the City Council approved a Council Policy relating to Permit Parking recommending that neighborhood residents work with Neighborhood Services District Teams in identifying solutions and that Permit parking be considered a solution of last resort to be considered only after other options have been evaluated and determined to be infeasible (the "Council Policy "); and WHEREAS, the Council Policy sets forth a process to create a Permit- Eligible Parking District, and, following approval of the District, establishing a process enabling individual streets within the identified District boundary to request implementation of permit parking; and WHEREAS, the steps recommended in the Council Policy have been duly followed to establish the Permit- Eligible Parking District No. 23 and designating Flicker Court and Thrasher Way as "Permit Parking Only" in the areas described and depicted in attached Exhibit "A "; and WHEREAS, representatives of the community have met with the Neighborhood Services District Team and the Public Works Department, and efforts to identify and implement solutions to the parking other than permit parking have been determined to be insufficiently effective to resolve or significantly improve parking problems, so that no solution other than permit parking appears to be feasible; and WHEREAS, the Police Department has performed field evaluation and determined that the criteria for proceeding with consideration of a district exist; and WHEREAS, a survey was sent to determine if residents are in favor of formation of a Permit - Eligible Parking District, and a minimum 30% response rate among single family homes was achieved with a simple majority of returned surveys in favor of establishing the District in conformance with the Council Policy; and 1 WHEREAS, the City Council finds that the approval of the establishment of the subject Permit- Eligible Parking District is exempt from the California Environmental quality Act (CEQA) pursuant to Regulation No. 15061(b)(3), incorporated herein by this reference, which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment; and WHEREAS, City Council wishes to establish Permit - Eligible Parking District No. 23; and WHEREAS, due to parking congestion on those streets hereinafter set forth, the City Council hereby finds and determines that parking on Flicker Court and Thrasher Way, as described below, should be limited to persons possessing permits; and WHEREAS, the establishment of a "Permit Parking Only" area on Flicker Court and Thrasher Way, as described below and as hereinafter set forth, is necessary to enhance the public health, safety and welfare of the residents of the area, the users of the public streets and the public at large. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that Permit- Eligible Parking District No. 23 be, and the same is hereby, established in the area depicted in attached Exhibit "A." BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that parking on the following City street segments, which are hereby designated as Permit Parking Area No. 23, shall be limited to those persons possessing a properly displayed valid parking permit: 1) Flicker Court from Laketop Drive to the end of Flicker Court; and 2) Thrasher Way from Laketop Drive to the end of Thrasher Way. Nothing contained in this resolution shall be construed to authorize parking or stopping where such parking or stopping is otherwise prohibited or to prohibit parking as it may otherwise be permitted by the California Vehicle Code or the Anaheim Municipal Code. 2 THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 26 day of March, 2013, by the following roll call vote: AYES: Mayor Tait, Council Members Eastman, Brandman, Murray, Kring NOES: None ABSENT: None ABSTAIN: None CITY OF HEIM ( -1_ , By MA OR OF THE CITY OF ANAHEIM ATTEST.
