RESOLUTION 2013- 046
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING AN ACCESS EASEMENT
LOCATED OVER PROPERTY GENERALLY KNOWN
AS 801 SOUTH BLUEBIRD CIRCLE, PURSUANT TO
CALIFORNIA STREETS AND HIGHWAY CODE
SECTION 8330, ET SEQ. - SUMMARY VACATION.
(ABANDONMENT NO. ABA2012- 00249)
WHEREAS, the City of Anaheim has received a request from an applicant for the
vacation of an existing public access easement over residential property generally known as 801
South Bluebird Circle, Anaheim, California, in order to clear title to the land and in order to alleviate
the property owner and Feather Hill Homeowner's Association from maintenance responsibility and
liability pertaining to the access improvements constructed outside the access easement; and
WHEREAS, the public service easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation and there are no
other public facilities located within the easement; and
WHEREAS, applicant will dedicate a new replacement access easement to reflect the
physical location of the existing access improvements; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public access easement, as set forth as follows: that
certain Access Easement over Lot number 42 as dedicated and depicted on Tract Map No. 9465,
recorded in Book 402, Pages 40 through 44, inclusive, of Miscellaneous Map, County Recorder's
Office, County of Orange, State of California.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
