A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ACCEPTING CERTAIN DEEDS CONVEYING TO
THE CITY OF ANAHEIM CERTAIN INTERESTS IN REAL
PROPERTIES.
WHEREAS, certain deeds described in Exhibit "A ", attached hereto and incorporated
by reference ( "DEEDS "), have been presented to the City of Anaheim ( "CITY" or "City of
Anaheim "); and
WHEREAS, the grantors, property interests conveyed and location of the property
described in the DEEDS are set forth in Exhibit "A "; and,
WHEREAS, the owners of those properties described in Exhibit "A" have offered to
convey to the CITY certain real property interests in connection with CITY utility service provided
to their property ( "Services "); and
WHEREAS, apart from the DEEDS, the Orange County Water District ( "OCWD ")
has offered to convey to the CITY certain real property interests contained in the easement deeds
attached to the staff report accompanying this Resolution and identified as City Deed 11577 and
11578 ( "OCWD DEEDS "); and
WHEREAS, this conveyance arose from the California Department of
Transportation's ( "Caltrans ") undertaking of a widening project of SR 91 ( "SR 91 Widening ") which
will require the replacement of a 1,400 foot section of a 36" CITY water main (the "Water Main ");
and
WHEREAS, the CITY has a preexisting easement for the Water Main in the area of
the SR 91 Widening, and it is for this reason Caltrans agreed to pay OCWD for a replacement
easement where the CITY will install a new 1,400 foot long water main to replace the Water Main;
and
WHEREAS, the City Council of the City of Anaheim does hereby find and determine
it is in the best interests of the CITY to accept the DEEDS, the executable originals of the OCWD
DEEDS, and the real property interests therein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The DEEDS and the real property interests therein are hereby accepted by the
City Council for no other consideration than the furnishing of Services in accordance with the Water
Rates, Rules, and Regulations and /or Electric Rates, Rules, and Regulations.
2. The OCWD DEEDS and the real property interests therein are hereby
accepted by the City Council for that consideration paid by Caltrans to OCWD pursuant to separate
agreements attached to the OCWD DEEDS for identification purposes only.
3. Nothing herein shall be construed to be an acceptance of any parcel or
property into the CITY street system (Streets and Highways Code Section 1806).
4. The Mayor is authorized to execute the OCWD DEEDS on behalf of the
CITY.
5. The City Clerk is authorized and directed to take any actions to cause the
DEEDS and the OCWD DEEDS to be recorded in the Office of the County Recorder of the County
of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City
of Anaheim this 11 t-h Day of June , 2013, by the following roll call vote:
