A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM CONSENTING TO THE ESTABLISHMENT OF A
PORTION OF LINCOLN AVENUE AS A COUNTY
HIGHWAY.
WHEREAS, the Board of Supervisors of the County of Orange has adopted,
pursuant to the provisions of the Streets and Highways Code (Sections 1700 et seq.), Resolution
No.13 -032, which Resolution does declare a portion of Lincoln Avenue which lies within the
boundaries of the City of Anaheim, to be a county highway for purposes of design, right -of -way
acquisition, and construction during the construction of roadway improvements along Lincoln
Avenue; and,
WHEREAS, Section 1701 of the Streets and Highways Code provides that the
governing body of a city may consent to the establishment of a city street, or portion thereof, as a
county highway in accordance with the resolution of the Board of Supervisors; and
WHEREAS, the County of Orange ( "County ") and the City of Anaheim ( "City ")
propose to construct roadway improvements along Lincoln Avenue including the bridge over the
Santa Ana River ( "City Streets "); and
WHEREAS, the County and the City have entered into Agreement No. D12 -026
to define the responsibilities of the County and the City with respect to the construction of the
City Streets; and
WHEREAS, Streets and Highways Code Section 1700 -1704 set forth the
procedures by which the County may perform improvements on City Streets; and
WHEREAS, the proposed roadway improvements along that portion of Lincoln
Avenue as hereinafter described in the City of Anaheim as a County Highway is in the best
interest of the City of Anaheim and its residents; and
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby consent to the establishment of that portion of Lincoln Avenue, from
approximately pier #3 and roadways west of Santa Ana River from the bridge to Rio Vista
Street, as a county highway for purposes of design, right -of -way acquisition and construction.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 11 th day of June , 2013.
